COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 060476

 

Amending a previously approved development plan in District GP-7 on approximately 9.33 acres generally located on the northwest corner of N. Congress Avenue and N.W. Barry Road (7600 N.W. Barry Road). (9527-GP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-7 (Kansas City International Airport General Planned Development District, Agricultural and Low Density Residential Uses) on 9.33 acres generally located on the northwest corner of N. Congress Avenue and N.W. Barry Road (7600 N.W. Barry Road), and more specifically described as follows:

 

Part of the East half of the Northwest Quarter of Section 12, Township 51 North, Range 34 West, in Kansas City, Platte County, Missouri; Commencing at the Southeast corner of said Northwest Quarter of said Section 12, thence N8950'06"W along the South line of said Northwest Quarter, a distance of 440.45 feet (440.00 feet Deed); thence N0005'12"E, a distance of 40.00 feet to the Point of Beginning of the tract to be herein described; thence continuing N0005'12"E to the Southeast corner of Wildberry Lots 1 thru 60, a subdivision in Kansas City, Platte County, Missouri a distance of 10.00 feet; thence continuing N0005'12"E along the East line of said Wildberry Lots 1 thru 60, a distance of 820.00 feet to the Northeast corner of said Wildberry and the Southeast corner of Wildberry Fourth Plat, a subdivision in Kansas City, Platte County, Missouri; thence N0010'40"E along the East line of said Wildberry Fourth Plat, a distance of 120.00 feet to a point on the South line of said Wildberry Fourth Plat; thence S8950'06"E along the South line of said Wildberry Fourth Plat and parallel to the South line of said Northwest quarter, a distance of 441.50 feet; (440.00 feet Deed, 441.50 feet plat) to point on the East line of said Northwest Quarter of said Section 12 and the Westerly right of way line of North Congress Avenue (as now established); thence S0009'30"W along said East line of the Northwest Quarter and said right of way line, a distance of 490.15 feet to a curve to the right having an initial tangent bearing of N 018'12" E and a radius of 795.00 feet; thence along said Westerly right of way line and curve to the right an arc distance of 163.67 feet; thence S1157'55"W along said Westerly right of way line, a distance of 99.99 feet to a curve to the left having an initial tangent bearing of N 1145'15" E an a radius of 400.00 feet; thence along said Westerly right of way and curve to the left an arc distance of 82.24 feet; thence S0009'30"W along said Westerly right of way, a distance of 108.76 feet; to a point on the Northerly Right of way for N Barry Road (as now established); thence S3719'49"W along said Westerly right of way, a distance of 12.69 feet to a point on the Northerly Right of way for N Barry Road (as now established); thence N8950'06"W along said Northerly right of way, and Parallel to the South line of said Northwest Quarter a distance of 385.89 feet to the Point of Beginning. Containing 406,479.50 Sq. Ft. or 9.33 acres more or less.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer submit a macro/micro storm drainage study to the City for approval when the first plat is submitted and that the developer make any improvements as required.

 

3.                  That the developer secure permits to construct or reconstruct existing sidewalks, curb, and gutter as necessary along all development street frontages, or submit a letter from a Missouri Licensed Civil Engineer stating that the sidewalks, curb and gutter are in a good state of repair and meet the requirements set forth in Chapter 56 and 64, Code of Ordinances, as required by Development Services, prior to recording the plat.

 

4.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

5.                  That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

6.                  That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.

 

7.                  That the developer extend water mains as required by the Water Services Department.

 

8.                  That the developer secure the approval of the Board of Zoning Adjustment for a variance to the required 50 foot GP District setback for building and paving (for parking adjacent to N. Congress Avenue and N. W. Barry Road.)

 

9.                  That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

10.              That the developer provide fire protection as required by the Fire Department.

 

11.              That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping, screening, berming, lighting (provide a photometric study, with the intent that there shall be no direct illumination beyond the property line), signage, and building elevation drawings.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
