Rezoning
an area of approximately 8.93 acres generally located on the west side of Blue
Ridge Extension, north of Longview Road (approximately 11400 Blue Ridge
Extension) from Districts R-4, C-1 and C-2 to District R-4.
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That Chapter 80, Code of Ordinances of
the City of Kansas City, Missouri, 1996, commonly known as the Zoning
Ordinance, is hereby amended by enacting a new section to be known as Section
80-11A687, rezoning an area of approximately 8.93 acres generally located on
the west side of Blue Ridge Extension, north of Longview Road (approximately
11400 Blue Ridge Extension) from Districts R-4 (Low Apartments), C-1
(Neighborhood Retail Business), and C-2 (Local Retail Business) to District R-4 (Low Apartments), said section to read as
follows:
Section
80-11A687. That an area legally described as:
All that part of Lot 1101, RESURVEY OF LOTS 1098, 1099
AND 1100, RUSKIN HEIGHTS, a subdivision in Kansas City, Jackson County,
Missouri, lying Southerly of a line drawn parallel with and distant Southerly
400 feet (measured at right angles) of the Northerly line of said Lot 1101,
except that part of said Lot 1101 described as follows: Beginning at the
Southeasterly corner of said Lot 1101; thence Northeasterly along the Westerly
line of Blue Ridge Extension, a distance of 250 feet; thence West parallel with
the North line of Longview Road, a distance of 150 feet; thence Southwesterly
parallel to the Westerly line of said Blue Ridge Extension, a distance of 100
feet more or less, to a point in a line that is parallel with said North line
of Longview Road and that passes through a point on the Westerly line of Blue
Ridge Extension, said point Being 150 feet Northeasterly along said Westerly
line from said Southeasterly corner of lot 1101; thence West along said
parallel line to a point in the West line of said Lot 1101; thence South along
said West line to the Southwest corner on the South line of said Lot 1101; thence
East along the North line of Longview Road to the Point of Beginning; AND
All that part of Lot 1101, RESURVEY OF LOTS 1098, 1099
AND 1100, RUSKIN HEIGHTS, a subdivision in Kansas City, Jackson County,
Missouri, being more particularly described as follows: Commencing at the
Southeasterly corner of said Lot 1101 being also a point of intersection of the
Northwesterly right-of-way line of Blue Ridge Extension with the Northerly
right-of-way line of Longview Road, as said extension and road are now both
established; thence South 80 degrees 47 minutes 01 second West along the South
line of said Lot 1101 and along said Northerly right-of-way line, a distance of
150.00 feet to the Point of Beginning of a tract of land to be herein
described; thence continuing along the last described course, a distance of
141.41 feet to the Southwest corner of said Lot 1101, being also a point of
intersection of said Northerly right-of-way line with the Easterly right-of-way
line of Bennington Avenue, as now established; thence North 10 degrees 44
minutes 37 seconds West along the Westerly line of said Lot 1101, and along
said Easterly right-of-way line, a distance of 112.56 feet; thence North 80
degrees 47 minutes 01 second East, parallel with said Northerly right-of-way
line, a distance of 243.58 feet to a point, said point being 150.00 feet
distant West of the Northwesterly right-of-way line of said Blue Ridge
Extension; as measured along a line that is parallel with the Northerly
right-of-way line of said Longview Road from a point that is 150.00 feet
Northeasterly from the Southeasterly corner of said Lot 1101, as measured along
said Northwesterly right-of-way line; thence South 32 degrees 10 minutes 25
seconds West, 149.98 feet to the Point of Beginning, except that part in roads,
that part of the land taken for Longview Road improvements as condemned under
Suit No. CV95-6317, filed in Circuit Court of Jackson County, Missouri at Kansas City and in the Report of Commissioners recorded as Document No.
K1221448 in Book K2767 at Page 840.
is hereby rezoned from District R-4 (Low Apartments), C-1 (Neighborhood Retail
Business) and C-2 (Local Retail Business) to District R-4 (Low Apartments) all
as shown outlined on a map marked Section 80-11A0687, which is attached hereto
and made a part hereof, and which is hereby adopted as a part of an amendment
to the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
