ORDINANCE NO. 950726

 

Authorizing the Director of City Development to enter into a Cooperative Agreement with the Land Clearance for Redevelopment Authority of Kansas City and providing for the sale of real estate commonly known as the Diagnostic and Treatment Center for a consideration of $10.00 for the continued development as a medical facility offering services for area residents and directing the City Clerk to record that agreement with the appropriate departments.

 

WHEREAS, the City of Kansas City, Missouri owns the real estate commonly known as the Diagnostic and Treatment Center generally located at 660 East 24th Street; and

 

WHEREAS, the premises was constructed for use as a diagnostic and treatment center as part of the Hospital Hill facilities and has been used as such since that time by General Hospital and Medical Center and then to the successor, Truman Medical Center who has leased, operated and maintained the property for nearly 30 years; and

 

WHEREAS, all the City Departments have been notified that the herein described land and building is in excess of the needs of the City and no interest has been expressed in retaining the land for future public use; and

 

WHEREAS, the City now desires to sell said property and provide for its continued development for use as a Diagnostic and Treatment Center; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Council does hereby approve and authorize the transfer and sale of the City-owned property generally located at 660 East 24th Street in Kansas City, Jackson County, Missouri, commonly known as the Diagnostic and Treatment Center to the Land Clearance for Redevelopment Authority for the sum of $10.00 for development of the property for continued use as a medical facility in accordance with a Cooperative Agreement, a copy of which is attached hereto and made a part hereof at this place by reference and which is hereby accepted and approved.

 

Section 2. That the description of the real property approved for sale hereunder is as follows:

 

All that part of the northwest 1/4 of the southeast 1/4 of Section 8, Township 49, Range 33, including the west of vacated Kenwood Avenue under Ordinance No. 60410, in Kansas City, Jackson County, Missouri, described as follows: Beginning at the point of intersection of the centerline of vacated Kenwood Avenue (Vacation Ordinance No. 60410, 1/87) with the north right of way line of 24th Street as established by Ordinance No. 6388; thence north 8706'13" west along the aforesaid north right of way line, 92.03 feet to a point; thence north 0306'37 east, 128.05 feet; thence north 4706'15" west, 15.49 feet; thence north 0241'31" east, 35.30 feet; thence north 5155'42" east, 15.32 feet; thence north 0241'31" east, 75.94 feet; thence north 5910'56" east, 74.27 feet to a point on the west right of way line of vacated Kenwood Avenue 114.21 feet south of the north line of the southeast 1/4 of Section 8, thence east parallel with the north line of the southwest 1/4 (south 8733'03" east), 27.95 feet to the centerline of vacated Kenwood Avenue; thence along the centerline of vacated Kenwood Avenue (south 0226'57" west, 300.74 feet) to the point of beginning.

 

Section 3. That the revenue in Account No. 95-100-064-8500 is hereby estimated in the amount of $10.00.

 

Section 4. That the Director of City Development is hereby authorized to enter into a Cooperative Agreement with the Land Clearance for Redevelopment Authority of Kansas City for the sale of the Diagnostic and Treatment Center.

 

Section 5. That the City Clerk is hereby directed to record copies of this Cooperative Agreement in the Office of the Secretary of State for the State of Missouri and the Director of Records for Jackson County, Missouri, at Kansas City, as provided by State Statute Section 70.300.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
