ORDINANCE NO. 180943

 

Rezoning approximately 97.7 acres generally located on the north side of N.E. 104th Street, 2,150 feet east of Missouri Highway 291, from Districts R-7.5 and R-80 to District R-7.5. (CD-CPC-2018-00179)


BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1178, rezoning an area of approximately 97.7 acres generally located on the north side of N.E. 104th Street, 2,150 ft. east of Missouri Highway 291, from Districts R-7.5 (Residential, 7,500 sq. ft. per unit) and R-80 (Residential, 80,000 sq. ft. per unit) to District R-7.5 (Residential, 7,500 sq. ft. per unit), said section to read as follows: 

 

Section 88-20A1178. That an area legally described as:

 

The East Half of the Southeast 1/4, together with the South Half of the Southeast 1/4 of the Northeast 1/4 all in Section 26, Township 52 North, Range 32 West of the 5th Principal Meridian, Kansas City, Clay County, Missouri, all more particularly described as follows: Commencing at the southeast corner of said Section 26; thence North 0 degrees 30 minutes 11 seconds East on the east line of the Southeast Quarter of said Section 26, 40.00 feet to north right-of-way line of N.E. 104th Street and the point of beginning; thence North 89 degrees 32 minutes 57 second West on said north right-of-way line, being 40.00 feet north of, and parallel with, the south line of the Southeast 1/4 of said Section 26, 1316.62 feet to the west line of said East Half; thence North 0 degrees 31 minutes 29 second East on said west line, 2579.00 feet to the southwest corner of the Southeast 1/4 of the Northeast 1/4 of said Section 26; thence North 0 degrees 36 minutes 34 seconds East on the west line of said Southeast 1/4 of the Northeast 1/4, 655.52 feet to the northwest corner of said South Half; thence South 89 degrees 25 minutes 26 seconds East on the north line of said South Half, 1316.48 feet to the northeast corner of said South Half; thence South 0 degrees 40 minutes 54 seconds West on the east line of said Southeast 1/4 of the Northeast 1/4, 654.85 feet to the northeast corner of the Southeast 1/4 of said Section 26; thence South 0 degrees 30 minutes 11 seconds West on the east line of said Southeast 1/4, 2576.79 feet to the point of beginning. Containing 97.68 acres more or less. All bearings herein are referenced to the Missouri State Plane Coordinate System of 1983, West Zone.

 

is hereby rezoned from Districts R-7.5 (Residential, 7,500 sq. ft. per unit) and R-80 (Residential, 80,000 sq. ft. per unit) to District R-7.5 (Residential, 7,500 sq. ft. per unit), all as shown outlined on a map marked Section 88-20A1178, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof. 

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
