COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 950262

Authorizing the Director of Public Works to enter into an agreement with the Missouri Highway and Transportation Commission and Woodward-Clyde Consultants for a Phase I Environmental Site Assessment study of the roadway corridor along Chouteau Trafficway from Front Street north to I-35 and Front Street from I-435 west to I-29/I-35 and to expend $116,358.50 in previously appropriated funds therefor, and directing the City Clerk to record the ordinance.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Public Works is hereby authorized to enter into and execute, on behalf of Kansas City, a three party agreement between the Missouri Highway and Transportation Commission, Woodward-Clyde Consultants, and the City of Kansas City, Missouri, relating to Phase I Hazardous Waste Investigation for the proposed Route JCR along Front Street from Routes I-35/I-29 to Route I-435, Job No. J4U1253, and along Chouteau Connection from Route I-35 to Front Street, Job No. JAU1254, in Council District 1, Project No. 5352. The agreement shall be essentially in the form which is attached hereto and incorporated herein by reference.

Section 2. That the Director of Public Works is hereby authorized to expend the sum of $116,358.50 from funds heretofore appropriated to Account No. 95-206-089-7217-T as and for consideration in the aforesaid agreement.

Section 3. That when this ordinance becomes effective, the City Clerk shall cause a copy of the ordinance, with attachments, to be recorded in the office of the Recorder of Deeds for Jackson County and filed with the Secretary of State of Missouri in compliance with Section 70.300, RSMo.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
