ORDINANCE NO. 010486

 

Authorizing an Amendment 1 to a Cooperative Agreement for Sewer Service between Kansas City and the Unified Government of Wyandotte County/Kansas City, Kansas; and directing the City Clerk to record same.

 

WHEREAS, the City Council passed Ordinance No. 970620 on May 22, 1997 authorizing a Cooperative Agreement between Kansas City, Missouri and Kansas City, Kansas for a term of twenty (20) years; and

 

WHEREAS, the Unified Government of Wyandotte County/Kansas City, Kansas became the successor of Kansas City, Kansas for the purpose of this Agreement; and

 

WHEREAS, Kansas City, Missouri and the Unified Government of Wyandotte County/ Kansas City, Kansas have an interest in modifications to this Agreement; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Water Services is hereby authorized to execute, on behalf of Kansas City, an Amendment 1 to the Cooperative Agreement for Sewer Services between Kansas City and the Unified Government of Wyandotte County/Kansas City, Kansas modifying the rate structure for biosolids processing, providing for a joint efficiencies of operation study and clarifying succession in parties from Kansas City, Kansas to the Unified Government of Wyandotte County/ Kansas City, Kansas. A copy of the Amendment is on file in the office of the Director of Water Services.

 

Section 2. That upon the effective date of said Amendment, the City Clerk is directed to cause a copy of this ordinance and of the Amendment to be recorded in the Office of the Recorder of Deeds for Jackson County, Missouri and with the Secretary of State of Missouri, in accordance with Section 70.300, RSMo. (1994).
