ORDINANCE NO. 950464

 

Appropriating $8,341.00 and authorizing its expenditure for additional work required for reconstructing sidewalks and curbs along 72nd Terrace from Terrace Street to State Line Road previously authorized by ordinance, and recognizing an emergency.

 

WHEREAS, by Ordinance No. 940917, passed July 28, 1994, the Council authorized a contract with Vision Construction Company in the amount of $92,919.36 with an authorized expenditure of $116,355.98; and

 

WHEREAS, during the course of the work, certain latent conditions which have resulted in additional engineering and construction work have come to light; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the appropriation in the Revolving Public Improvement Fund Account No. 95-319-089-7763-T is hereby reduced in the amount of $8,341.00.

 

Section 2. That the sum of $8,341.00 is appropriated from the Unappropriated Fund Balance of the Revolving Public Improvement Fund to Project Account No. 95-319-089-6439-T, to be used within that account as follows:

 

To Account No. 95-319-089-6439-T the sum of $7,190.00 for construction; To Account No. 95-319-089-6439-T the sum of $1,079.00 for engineering and supervision; To Account No. 95-319-089-6439-T the sum of $72.00 for administration;

 

and the Director of Public Works is hereby authorized to expend the said sum for the purposes appropriated.

 

Section 3. That since the public improvement provided for herein is to be paid in part by special assessments, this ordinance is recognized to be an emergency measure within the provisions of Article II, Section 15 of the Charter and shall take effect immediately upon passage.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
