COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 071365

Authorizing the dedication of City owned property for public utility purposes in connection with the vehicle impound facility located in the southwest quarter of Section 19 Township 50 Range 32, and the northwest quarter of Section 30 Township 50 Range 32, all in Kansas City, Jackson County, Missouri.

WHEREAS, a portion of property located in southwest quarter of Section 19 Township 50 Range 32, and the northwest quarter of Section 30 Township 50 Range 32, all in Kansas City, Jackson County, Missouri, is required for the extension of public utilities for the proposed vehicle impound facility; and

WHEREAS, the City dedicates a portion thereof for public utility purposes as part of the vehicle impound facility; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City hereby dedicates a portion of the property for use by Kansas City, Missouri, and with the City's permission, utility companies franchised to operate in Kansas City, Missouri, to locate, construct, reconstruct, operate, repair and maintain facilities including, but not limited to, water, gas, electricity, sewerage, telephone, cable TV, drainage, underground conduits, pad mounted transformers, service pedestals, poles, pipes, ducts and wires, any and all of them upon, over, under and along the following described tract of land lying, being and situate in the southwest quarter of Section 19 Township 50 Range 32, and the northwest quarter of Section 30 Township 50 Range 32, all in Kansas City, Jackson County, Missouri, and more particularly described as follows:

Commencing at the northeast corner of the northwest quarter of said Section 30; thence north 87 degrees 41 minutes 49 seconds west, along the north line of said northwest quarter Section 30, a distance of 932.60 feet to the point of beginning; thence north 01 degree 54 minutes 27 seconds east, a distance of 1802.43 feet; thence north 41 degrees 57 minutes 08 seconds west, a distance of 116.18 feet; thence south 01 degree 54 minutes 27 seconds west, a distance of 1885.65 feet to the north line of said northwest quarter Section 30; thence continuing south 01 degree 54 minutes 27 seconds west, a distance of 376.59 feet to a point of tangency; thence along a curve to the right, having a radius of 4964.50 feet, an initial tangent bearing of south 01 degree 54 minutes 27 seconds west, and an arc length of 275.40 feet, to a point of tangency; thence along a curve to the right, having a radius of 414.50 feet, an initial tangent bearing of south 05 degrees 05 minutes 09 seconds west, and an arc length of 235.27 feet to a point of reverse curvature; thence along a curve to the left, having a radius of 513.00 feet, an initial tangent bearing of south 37 degrees 36 minutes 23 seconds west, and an arc length of 316.02 feet to a point of tangency; thence south 02 degrees 18 minutes 39 seconds west, a distance of 53.04 feet; thence south 87 degrees 41 minutes 21 seconds east, a distance of 262.15 feet; thence north 01 degree 54 minutes 27 seconds east, a distance of 1220.79 feet to the point of beginning. Said tract containing 7.10 acres more or less.
