ORDINANCE NO. 180794
Authorizing the Director of Public Works to enter into a
Cooperative Agreement with Buckeye Pipeline Transportation, LLC in the amount
of $629,294.00 for the removal and relocation of a pipeline and other
facilities in the N.E. 104th Street Improvements; and recognizing this
ordinance as having an accelerated effective date.
WHEREAS, the
City has determined that it is necessary to relocate a pipeline and other
facilities in the area of the Project to accommodate construction; and
WHEREAS, the
City has agreed to reimburse Buckeye Pipeline Transportation, LLC for the cost
associated with the removal and relocation of a 150 foot pipeline and other
facilities within an existing easement owned by Buckeye Pipeline
Transportation, LLC; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section 1. That
the Director of Public Works is hereby authorized to execute an Cooperative
Agreement in the amount of $629,294.00 from funds previously appropriated to
account number 19-3090-898041-B-89008535 with Buckeye Pipeline Transportation,
LLC for removal and relocation of a pipeline and other facilities in Project
No. 89008535 – N.E. 104th Street Improvements. A copy of the agreement is on
file in the Public Works Department.
Section 2. That this ordinance, relating to the design,
repair, maintenance or construction of a public improvement, is recognized as
an ordinance with an accelerated effective date as provided by Section
503(a)(3)(D) of the City Charter and shall take effect in accordance with
Section 503, City Charter.

I hereby certify that there is a balance, otherwise
unencumbered, to the credit of the appropriation to which the foregoing
expenditure is to be charged, and a cash balance, otherwise unencumbered, in
the treasury, to the credit of the fund from which payment is to be made, each
sufficient to meet the obligation hereby incurred.
