ORDINANCE NO. 190284

 

 

Authorizing a $200,000.00 increase to the contingency amount of Project No. 07001306, Municipal Service Center Fuel Station construction contract with Gunter Construction Company for the replacement of the fueling station at the Municipal Service Center at 5300 Municipal Avenue; and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, the Council passed Ordinance No. 180585 authorizing the Director of General Services to execute a contract with Gunter Construction Company in the amount of $1,464,269.50 for construction of scope including removal of the existing fueling station and all related equipment and replace with new tanks, dispensers, and provide a covered area for fueling of City vehicles, a copy of which contract is on file in the General Services Department; and

 

WHEREAS, Ordinance No. 180585 authorized the Director of the General Services Department to amend said contract in an amount not to exceed $290,000.00 (“Contingency”) without further authorization of the City Council, for a total contract authorization of $1,754,269.50, from funds previously appropriated to Account No. AL-3437-079706-B; and

 

WHEREAS, additional, unanticipated environmental remediation work is necessary at the site; and

 

WHEREAS, the cost of the necessary environmental remediation work exceeds the contingency provided for by Ordinance No. 180585; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the contingency of the contract with Gunter Construction Company, for Project No. 07001306 – Municipal Service Center Fuel Station, is increased in the amount of $200,000.00 to cover additional construction services from funds previously appropriated to Account No. AL-3437-079706-B.

 

Section 2. That this ordinance is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(C) of the City Charter in that it appropriates money, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
