ORDINANCE NO. 061403

 

Rezoning approximately 18 acres generally located at the southwest corner of Wornall Road and W. 81st Street from District R-4 to District PD/R-4, and approving a development plan for the same. (13651-PD-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by adding a new section to be known as Section 80-11A0726, rezoning approximately 18 acres generally located at the southwest corner of Wornall Road and W. 81st Street from District R-4 (Low Apartments) to District PD/R-4 (Planned District/Low Apartments), said section to read as follows:

 

Section 80-11A0726. That an area legally described as:

 

All that part of the north 26 and 2/3 acres of the Southeast Quarter of the Southeast Quarter of Section 18, Township 48, Range 33, in Kansas City, Jackson County, Missouri that lies east of the east line of Jefferson Street, except that part described as follows: Beginning at the intersection of the east line of Jefferson Street and the south line of 81st Street; thence south along said east line 675 feet; thence east 78.48 feet; thence North 41 degrees 37 minutes 08 seconds East, 204.74 feet; thence north 504 feet more or less to said south line of said 81st Street; thence west along said south line a distance 200 feet to the point of beginning and also except that part in streets.

 

is hereby rezoned from District R-4 (Low Apartments) to District PD/R-4 (Planned District/Low Apartments), all as shown outlined on a map marked Section 80-11A0726, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer submit a macro/micro storm drainage study to Development Services for review and acceptance for the entire development when the first plat is submitted, and that the developer construct any improvements as required by Development Services.

 

3.                  That the developer dedicate additional right of way for a secondary arterial as required by Development Services so as to provide a minimum of 40 feet of right of way as measured from the centerline of Wornall Road.

 

4.                  That the developer subordinate to the City all private interest in the area of any right of way dedication as required by Development Services, and that the developer be responsible for all costs associated with subordination activities.

 

5.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

6.                  That the developer secure a land disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

7.                  That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by Development Services.

 

8.                  That the developer provide a storm water conveyance system to serve all proposed lots within the development and determine adequacy as required by Development Services.

 

9.                  That the developer submit covenants, conditions and restrictions to Development Services for review by the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any storm water detention area tracts.

 

10.              That the developer provide cross access easements on the final plat as required by Development Services.

 

11.              That the developer submit applications to the Board of Zoning Adjustment for any required variances and that the developer seek a parking requirement modification for the required number of parking spaces on Lots 1 and 2.

 

12.              That the developer provide $11,475.78 in lieu of parkland dedication prior to recording of the final plat (96 units x 2.0 x.006 x $9,961.61) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

13.              That the developer submit a final plan to the City Plan Commission for approval, including plans for grading, landscaping, screening, berming, lighting (provide a photometric study, with the intent that there shall be no direct illumination beyond the property line), signage, and building elevation drawings.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
