ORDINANCE NO. 080651

Authorizing the Director of Convention and Entertainment Facilities to enter into a Lease Agreement with the American Royal Association for land next to the American Royal Building that will include construction of a temporary horse barn facility.

WHEREAS, the City and the American Royal Association (Association) have previously entered into a Facilities Agreement dated as of January 1, 1995, as amended, in which the City leased certain portions of the property to the Association; and

WHEREAS, the City and the Association are parties to that certain lease for the Scott Pavilion and Scott Storage Area dated June 1, 1999; and

WHEREAS, the Association has historically conducted and continues to conduct annually the American Royal Livestock, Horse Show, Rodeo, as well as numerous other educational activities that benefit the City and the Greater Kansas City community; and

WHEREAS, the Association wishes to lease more space adjacent to previously leased space for the purpose of the construction, use and operation of a temporary horse barn facility at the Association's sole cost and expense; and

WHEREAS, such space is more accurately set forth in the lease agreement; and

WHEREAS, the horse barn facility will assist the Association in improving current events and attracting future events; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Convention and Entertainment Facilities is authorized to enter into a Lease Agreement with the American Royal Association for certain land adjacent to the American Royal Building in the West Bottoms for the purpose of construction, use and operation of a temporary horse barn facility at Association's sole cost and expense. Such lease may last for a period of up to 25 years from the date of the lease, unless the horse barn is removed from the premises or the current Facilities Agreement expires or is terminated.
