COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 900714

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2317, rezoning an area of approximately 4.96 acres within a portion of the block bounded by 25th and 26th Streets, Brooklyn and Euclid Avenues, except the northwest corner of 26th Street and Brooklyn Avenue from Districts R-5-p (High Apartment - Limited District) and CP-1 (Neighborhood Retail Business Center) to District URD (Urban Redevelopment District), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2317, rezoning an area of approximately 4.96 acres within a portion of the block bounded by 25th and 26th Streets, Brooklyn and Euclid Avenues, except the northwest corner of 26th Street and Brooklyn Avenue, from District R-5-p (high apartment - limited district) and CP-1 (neighborhood retail business center) to District URD (urban redevelopment district), said section to read as follows:

 

Section 65.010A2317. That an area legally described as:

 

Part of the East 7 1/2 feet of the Northwest 1/4 of the Southwest 1/4 of the Southeast 1/4 and the Northeast 1/4 of the Southwest 1/4 of the Southeast 1/4 of Section 9, Township 49, Range 33, Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the point of intersection of the North right of way line of 26th Street (25 feet from the centerline thereof) and the East right of way line of Euclid Avenue (said Avenue being 39.2 feet in width at this point); thence North 0 degrees 08 minutes East along said East line of Euclid Avenue, 609.66 feet to the intersection of said East right of way of Euclid Avenue and the South right of way line of 25th Street (25 feet from the centerline thereof); thence South 89 degrees 41 minutes 05 seconds East along said South right of way line of 25th Street 477.81 feet; thence South 0 degrees 01 minutes 06 seconds East 150 feet; thence South 89 degrees 41 minutes 05 seconds East 150 feet to the West right of way line of Brooklyn Avenue (35 feet from the centerline thereof); thence South 0 degrees 01 minutes 06 seconds East along said West right of way of Brooklyn Avenue 50.20 feet; thence West 265 feet; thence South 0 degrees 01 minutes 06 seconds East 202 feet (202.99 feet Deed); thence West 17 feet; thence South 0 degrees 01 minutes 06 seconds East 204 feet to the North right of way line of 26th Street; thence West along said North right of way line of 26th Street 346.83 feet to the point of beginning.
is hereby rezoned from Districts R-5-p (high apartment - limited district) and District CP-1 (neighborhood retail business center) to District URD (urban redevelopment District), all as shown outlined on a map marked Section 65.010A2317, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer secure the approval of the Board of Zoning Adjustment for modification of the parking

requirements to provide 78 spaces in lieu of the required

115.

 

2. That the developer pay money in lieu of parkland dedication in the amount of $6,166.14 for 115 elderly

housing units.

 

3. That the developer cause the area to be platted and processed in accordance with Chapter 31, Code of General

Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

4. That the developer submit a storm drainage study for review and approval by the City Engineer.

 

5. That the developer provide fire protection and water service within 150 feet of every building point.

 

6. That the developer dedicate additional right-of-way to provide an additional 4 feet for Euclid Avenue, 10 feet

for Brooklyn Avenue and 15 feet for 25th Street.

 

7. That the developer improve one-half of 25th Street to arterial standards.

 

8. That the developer reconstruct curbs, gutters and sidewalks as necessary along the perimeter streets.

 

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 900714 which is attached hereto and made a part hereof.

 


Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
