ORDINANCE NO. 051148

 

Rescinding Ordinance No. 040002 and enacting in lieu thereof a new ordinance correcting the legal description and approving the sale of the vacant lot located at Richards-Gebaur Airport, Tract #A103 and authorizing the Director of Finance to execute a deed therefore and directing the City Clerk to file same.

 

WHEREAS, Committee Substitute for Resolution No. 030902 passed August 21, 2003, declared the property in excess to the Citys needs for public use and authorized the sale by competitive bids; and

 

WHEREAS, the City, by the competitive bid process, on December 9, 2003, received a bid from Botts Road Development, LLC, a Missouri limited liability company, Post Office Box 411299, Kansas City, Missouri 64141-1299, who offered $30,000.00 for the property; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council hereby accepts the bid from Botts Road Development, LLC, a Missouri limited liability company, in the amount of $30,000.00, for the property located at Richards-Gebaur Airport, Tract #A103 and approves the sale of said property to them and hereby authorizes the Director of Finance to execute a Special Warranty Deed conveying the property legally described as follows:

 

Tract #A-1-3 Grandview Radio Beacon: All that part of the Southeast Quarter of the Southwest Quarter of Section 27, Township 47, Range 33, in Kansas City, Jackson County, Missouri, described as follows: Commencing at the southeast corner of said Quarter Quarter Section; thence North 86o2736 West along the south line of said Quarter Quarter Section, a distance of 415.80 feet; thence North 10o2029 East, a distance of 673.15 feet to the true point of beginning of the tract of land described; thence North 10o2029 East a distance of 500 feet; thence South 79o3931 East, a distance of 200 feet; thence South 10o2029 West, a distance of 500 feet; thence North 79o3931 West, a distance of 200 feet to the true point of beginning; and,

 

A perpetual, non-exclusive and assignable aeronautical property, easement and right-of-way to construct, maintain, repair, operate, patrol, replace and/or remove a roadway in, upon, under, over and across the following: A tract of land situated in the Southeast Quarter of the Southwest Quarter of Section 27, Township 47 North, Range 33 West, Jackson County, Missouri, more particularly described as follows: A strip of land 25 feet in width, lying 12.5 feet on either side of a line described as beginning at a point on the south line of said Southeast Quarter of the Southwest Quarter said point being 403.21 feet west of the southeast corner thereof; thence in a northeasterly direction, making an angle of 83o1155 with the south line of Southeast Quarter of the Southwest Quarter, 671.88 feet. Subject to restrictions, reservations, easements, covenants and special assessments, if any of record.

 

Section 2. That the revenue in the following account of the General Fund is hereby estimated in the following amount:

 

06-8300-621010-470810 Land Rent Other $30,000.00

 

Section 3. That the City Clerk is hereby directed to record a copy of this ordinance in the office of the Recorder of Deeds for Jackson County, at Kansas City, Missouri, as evidence of the sale of the herein described property by the City.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
