ORDINANCE NO. 180210

 

Reducing an appropriation of $400,000.00 in the Capital Improvements Fund; appropriating that amount from the Unappropriated Fund Balance in the Capital Improvements Fund the 18th & Vine Phase 1-3 account; authorizing the Director of City Planning and Development to execute Change Order No. 2 with Mega Industries Corp. in the amount of $632,068.00 for the 18th & Vince Phase 1-3 project; and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, on June 15, 2017, the Council approved Ordinance No. 170664, a construction contract with Mega Industries Corp. in the amount of $1,600,000.00 for the Project; and

 

WHEREAS, on December 1, 2016, the Director of City Planning and Development authorized Change Order No. 1 to include the water utility disconnect for demolition of the existing structure for an additional $10,685.13 to the Project; and

 

WHEREAS, Change Order No. 2 is needed to compensate the contractor for additional construction work to update street lighting and improve sidewalks; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Reducing $400,000.00 in the following account in the Capital Improvements Fund:

 

18-3090-108300-B-89009996 Contingency $400,000.00

 

Section 2. Appropriating the sum of $400,000.00 from the Unappropriated Fund Balance in the Capital Improvements Fund to the following account:

 

18-3090-648043-B-64017101 18th and Vine Phase 1-3 $400,000.00

 

Section 3. That the Director of City Planning and Development is hereby authorized to expend the sum of $632,068.00 from funds previously appropriated to the following accounts:

 

18-3090-648043-B-64017101 18th and Vine Phase 1-3 $400,000.00

AL-3436-648043-B-64017101 18th and Vine Phase 1-3 232,068.00

TOTAL $632.068.00

 

Section 4. That the Director of City Planning and Development is authorized to execute Change Order No. 2 for Project No. 64017101 18th and Vine Phase 1-3 in the amount of $632,068.00 with Mega Industries Corp for additional construction work, bringing the total contract amount to $2,076,052.13. A copy of the change order is on file in the City Planning and Development Department.

 

Section 5. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with Section 503, City Charter.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
