Rezoning an area of approximately 82.96 acres generally located on the east and west sides of N. Bennington Avenue, 1,750 feet south of N.E. Parvin Road from District M-2a/US to Districts R-4/US and R-4. (12570-P-2)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0649, rezoning an area of approximately 82.96 acres generally located on the east and west sides of N. Bennington Avenue, 1,750 feet south of N.E. Parvin Road from District M-2a/US (Heavy Industry/Underground Space) to Districts R-4/US (Low Apartment/Underground Space) and R-4 (Low Apartment), said section to read as follows:

 

Section 80-11A0649. That an area legally described as:

 

R-4 Tract: A tract of land in the East One-Half of Section 9, Township 50, Range 32, Kansas City, Clay County, Missouri, being bounded and described as follows: Beginning at the Southwest corner of the Northeast Quarter of said Section 9; thence North 0o32'59" East, along the West line of said Northeast Quarter, 2389.77 feet to the Southwest corner of Block 2, BENNINGTON CREST, a subdivision of land in Kansas City, Clay County, Missouri; thence South 89o18'38" East, along the South line of said Block 2, 652.96 feet; thence North 68o25'46" East, along said South line, 400.00 feet to the Southeast corner thereof; thence South 22o18'10" East, 184.14 feet; thence South 57o17'19" East, 271.75 feet; thence South 22o26'39" East, 329.75 feet; thence South 15o50'19" East, 625.08 feet to a point on the North line of RANDOLPH, a subdivision of land in Kansas City, Clay County, Missouri; thence North 89o29'36" West, along said North line, 338.70 feet to the Northwest corner thereof; thence South 0o23'33" West, along the West line of said RANDOLPH, 1040.70 feet to a point on the Northerly right-of-way line of Missouri Highway No. 210, as now established; thence South 49o21'56" West, along said right-of-way line, 559.14 feet; thence South 64o10'27" West, along said right-of-way line, 333.04 feet; thence South 41o24'53" West, along said right-of-way line, 694.35 feet; thence South 67o56'51" West, along said right-of-way line, 131.01 feet to a point on the West line of the Southeast Quarter of said Section 9; thence North 0o32'59" East, along said West line, 811.31 feet to the Point of Beginning. Containing 82.96 acres, more or less.

 

is hereby rezoned from District M-2a/US (Heavy Industry/Underground Space) to Districts R-4/US (Low Apartment/Underground Space) and R-4 (Low Apartment), all as shown outlined on a map marked Section 80-11A0649, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
