SECOND COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 900775

 

Amending Article XI of the Code of General Ordinances entitled Finances by enacting a new Section A11.88 entitled Recycled and Environmentally Preferable Products which deals with the purchasing of, and industrial standards for, recycled and environmentally preferable products and permits the payment of up to 10% above the lowest price bid for a product that does not utilize recycled materials in order to obtain a similar product that utilizes recycled materials and requires that product specifications and evaluations for awards of bids and contracts will consider the impact of the product on the environment in order that environmentally preferable products are purchased and establishing an effective date.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Sec. A11.88 Recycled and Environmentally Preferable Products.

 

Section (a). Purchases made in accordance with paragraph A11.80(a) shall be recycled and environmentally preferable products to the extent available in the market place at reasonable prices in order to conserve natural resources and to reduce the impact on the environment created by disposal.

 

Section (b). Products purchased under the authority contained in Section A11.80(a) will, when no longer usable or serviceable, be collected and recycled whenever a market or outlet is available.

 

Section (c). The commissioner of purchases and supplies is authorized to pay up to 10% above the lowest price bid for a product that does not utilize recycled materials in order to obtain a similar product that utilizes recycled materials. The commissioner of purchases and supplies is authorized to pay up to 5% above the lowest price bid for a product that does not meet an environmental preference requirement in order to obtain a similar product that meets an environmentally preferable requirement.

 

Section (d). Specifications for recycled and environmentally preferable products will be established by an industrial standards committee appointed by the commissioner of purchases and supplies and shall include city, industrial, and other governmental agency representation plus a representative of the City's Environmental Energy Commission and Waste Minimization Commission. The committee shall take cognizance of standards established by industry organizations, federal agencies such as the Environmental Protection Agency, nationally recognized standards organizations such as the American Society for Testing and Materials (ASTM), and
state agencies. Product specifications and bid evaluations for award of bids and contracts will consider the impact on the environment of the product in order that environmentally preferable products are purchased. The development of product specifications and the addition of new products to be included as recycled and environmentally preferable products will be coordinated periodically with the Waste Minimization Commission and the Environmental and Energy Commission of the City of Kansas City, Missouri.

 

Section (e). The City Manager shall develop, adopt and implement a policy encouraging the use of recycled and environmentally preferable products by its tenants, lessees and licensees when using City-owned, leased or controlled property and by its contractors, agents and employees when performing work for the City.

 

Section (f). This ordinance shall expire four (4) years from the effective date of the ordinance unless extended by vote of Council.

 

Section (g). This ordinance shall become effective ninety (90) days after its adoption.
