ORDINANCE NO. 100150
Enacting a new Section 2-1953, Code
of Ordinances, entitled “Passage of tax levy ordinances” to provide an
alternate date for passage of the annual tax levy ordinances from the fourth
Monday in March to March 31.
WHEREAS, Section
805(g) of the City Charter provides that “Whenever practicable, ordinances
fixing the tax levies shall be passed at the time the annual appropriation
ordinance is passed, but no later than the fourth Monday in March”; and
WHEREAS, Section
805(i) of the City Charter adds that “The Council may change the dates for the .
. . passage of the annual appropriation and tax levy ordinances” so long as the
ordinances are passed not later than 30 days before the beginning of the fiscal
year; and
WHEREAS, the fiscal
year begins on May 1 of each year, therefore the annual appropriation and tax
levy ordinances must be adopted no later than March 31; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That a
new Section 2-1953, code of ordinances, entitled “Passage of tax levy
ordinances” is enacted to read as follows:
Sec. 2-1953. Passage of tax levy ordinances.
(a) Authority to
establish date. This ordinance is adopted pursuant to the authority
granted the City Council by section 805(i) of the City Charter which authorizes
the establishment of new dates by which the various acts necessary to prepare,
consider, and adopt an annual budget and the necessary appropriation and tax
levy ordinances may be modified from the default procedures of the City
Charter.
(b) Intent
of ordinance. It is the intent of this ordinance to change the default
deadline for the passage of tax levy ordinances from the fourth Monday in March
to the last day of March.
(c) Passage
of tax levy ordinances. The annual tax levy ordinances shall be passed not
later than March 31 of each year.
