Rezoning an area of approximately
0.69 acres generally located at the southwest corner
of 8th Street and Bank Street from Districts
R-5-p and M-1 to District URD and approving a development plan for the
same. (9444-URD-4)
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section A. That
Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly
known as the Zoning Ordinance, is hereby amended by enacting a new section to
be known as Section 80-11A0809, rezoning an area of approximately 0.69 acres generally located at the southwest corner of 8th Street and
Bank Street from Districts R-5-p (High
Apartments-Limited District) and M-1 (Light Industry) to District URD (Urban
Redevelopment District), said section to read as follows:
Section 80-11A0809. That an area
legally described as:
TRACT I: The north
40 feet of Lot 20 and all of Lots 21 and 22, together with the vacated alley as
vacated by Ordinance Number 61706 filed as Document Number K-810709, in Block
2, Lucas Place, a subdivision of land in Kansas City, Jackson County, Missouri;
and
TRACT II: Part of
Lot 22, All of Lots 23 and 24, together with the east of the vacated alley
lying west of and adjoining said lots, as vacated by Ordinance Number 61706,
Filed as Document Number K-810709, in Block 2, LUCAS PLACE, a subdivision in
Kansas City, Jackson County, Missouri.
is hereby rezoned from Districts R-5-p (High Apartments-Limited District) and M-1
(Light Industry) to District URD (Urban Redevelopment District), all as
shown outlined on a map marked Section 80-11A0809, which is attached hereto and
made a part hereof, and which is hereby adopted as a part of an amendment to
the zoning maps constituting a part of said chapter and as an amendment to
Section 80-11 thereof.
Section B. That
a development plan for the area legally described above is hereby approved,
subject to the following conditions:
1.
That the developer submit a site plan to the Director of the Department
of City Development for approval prior to the issuance of a building permit.
The site plan shall include information regarding setback distances, lighting,
landscaping and architectural characteristics, trees and plantings around and
within the parking lot; and include elevation drawings of buildings and
signage.
2.
That the developer submit a letter from a licensed civil engineer, licensed
architect, or licensed landscape architect, who is registered in the State of Missouri, stating the condition of the sidewalks, curbs, and gutters. The letter must
identify state of repair as defined in Chapters 56 and 64, Code of Ordinances
for the sidewalks, curbs, and gutters. It shall identify the quantity and
location of sidewalks, curbs, gutters that need to be constructed, repaired, or
reconstructed. The developer shall secure permits to repair or reconstruct the
identified sidewalks, curbs, and gutters as necessary along all development
street frontages, as required by Development Services, prior to issuance of a
certificate of occupancy.
3.
That the developer submit plans for grading, siltation, and erosion
control to Development Services for review, acceptance, and permitting prior to
beginning any construction activities.
4.
That the developer submit a streetscape plan for approval and permitting
by Development Services prior to beginning work in the public right of way
prior to issuance of building permits.
A copy of said development plan
is on file in the office of the City Clerk with this ordinance and is made a
part hereof.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
