COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 140245

 

Approving the deletion of a Chapter 80 development plan on about 8 acres generally located on the south side of US Highway 40 and on the west side of Logan Avenue; imposing zoning conditions on the development of property on the site. (10389-P-4)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A.  That the deletion of a Chapter 80 development plan on an 8 acre site in District B2-2 (Neighborhood Business) from the zoning attached to the following described property:

 

TRACT 1: Lots 4,5, 6 and 7, Sni-A-Bar Addition, a subdivision in Kansas City, Jackson County, Missouri, except that part in Highway 40.

 

TRACT 2: Lots 8 and 9, except that part thereof in U.S. 40 Highway, as now established, and except that part taken for Carl Road, Sni-A-Bar Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

is hereby approved, but the following conditions shall remain applicable to the zoning on the property:

 

1.                  That the applicant combine the two lots located at 14605 E. US 40 Highway and 14635 E. US 40 Highway.

 

2. That only one curb cut off of E. US 40 Highway be allowed for site access, which must be aligned with (north/south) Fremont Street.

 

3.                  That only one curb cut off of Logan Avenue be allowed for site access, which must be aligned with the private drive on the east side of Logan Avenue approximately 220 feet south of E. US 40 Highway.

 

Section B. That the Council finds and declares that before taking any action on the proposed zoning changes hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
