ORDINANCE NO. 080509

 

Authorizing the Director of Public Works to execute a $2,923,183.50 contract with J.M. Fahey Construction Co., for the resurfacing of various streets; authorizing the expenditure of funds in the amount of $2,923,183.50; authorizing the Director of Public Works to execute change orders upon the City Managers approval; and recognizing an emergency.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public Works is hereby authorized to execute a contract, on behalf of the City, with J.M. Fahey Construction Co., in the amount of $2,923,183.50 for hot recycling, resurfacing and citywide cold milling of certain streets, trafficways and boulevards designated in Contract 08-2 and the performance of other incidental and related work in Kansas City, Missouri, generally south of the Missouri River. A copy of the contract is on file in the office of the Director of Public Works and is incorporated herein by reference.

 

Section 2. That the Director of Public Works is hereby authorized to expend the sum of $2,923,183.50 for the contract and for additional incidental and related work as described above, as follows:

 

09-3090-897701-B Street Preservation $2,923,183.50

Section 3. That the Director of Public Works is hereby authorized to execute change orders to the contract to provide for additional incidental and related resurfacing, to respond to requests from other departments for resurfacing subject to the limitation of appropriated funds and the City Managers approval, and to charge these costs to the reimbursable account.

 

Section 4. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an emergency measure within the provisions of Section 503 of the City Charter and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
