COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 051197

 

Vacating a portion of McGee Street between 13th Street and Interstate 670, the adjacent north-south alleys, 14th Street between Grand Boulevard and Oak Street and a portion of Interstate 670 at McGee Street, Kansas City, Jackson County, Missouri, and directing the City Clerk to file certain documents. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. The Council of Kansas City does hereby find and declare that on the 2nd day of September, 2005, a petition was filed with the City Clerk of Kansas City by the City of Kansas City for the vacation of McGee Street from a line drawn between the northeast corner of Lot 130, Block 9, McGees Addition, and the northwest corner of Lot 139, Block 10, McGees Addition, to the north line of Interstate 670 as now established, and the north-south alley next east of McGee Street from the north line of 14th Street north to its terminus as now established and from the south line of 14th Street to the north line of Interstate 670 as now established, and the north-south alley next west of McGee Street from the south line of 13th Street to the north line of Interstate 670 as now established, and 14th Street from the east line of Grand Boulevard to the west line of Oak Street as now established, and any existing right of way within a tract described as follows: Beginning at the southeast corner of Lot 148, Block 11, McGee's Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; thence S 02 18'41" W along the southerly prolongation of the east line of said Lot 148, a distance of 12.00 feet to a point on the westerly prolongation of the south line of the north 12.00 feet of Lot I, Block 66, said McGee's Addition; thence N 87 44'09" W along said westerly prolongation, a distance of 94.12 feet; thence S 47 26'27" W, a distance of 53.45 feet to a point on the easterly prolongation of the south line of Lot 158, Block 12, said McGee's Addition; thence N 87 33'33" W along said prolongation, a distance of 66.00 feet to the southeast corner of said Lot 158; thence N 02 18'41" E along the east line of said Lot 158, a distance of 49.48 feet to the intersection of said east line with the westerly prolongation of the south line of Lot 148, said Block 11; thence S 87 44'09" E along said prolongation and south line of said Lot 148, a distance of 198.00 feet to the point of beginning; and all utility easements over, under, across and along said street, alleys and right of way within said described tract, all in Section 5, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri, giving the distinct description of the street to be vacated, and also the names of the persons and corporations owning or claiming to own the property fronting thereon, and that due notice of the pendency of said petition has been given for a period of twenty (20) days in the newspaper doing the city printing, and that the consent of the persons and corporations owning or claiming to own three-fourths of the front feet of the property immediately adjoining said street has been obtained in writing, that said consent has been acknowledged as deeds are acknowledged, and was duly filed with the petition for such vacation in the City Clerk's Office.

 

Section 2. That the Council finds that the City Plan Commission has duly endorsed its approval of this Ordinance hereon.

 

Section 3. That McGee Street from a line drawn between the northeast corner of Lot 130, Block 9, McGees Addition, and the northwest corner of Lot 139, Block 10, McGees Addition, to the north line of Interstate 670 as now established, and the north-south alley next east of McGee Street from the north line of 14th Street north to its terminus as now established and from the south line of 14th Street to the north line of Interstate 670 as now established, and the north-south alley next west of McGee Street from the south line of 13th Street to the north line of Interstate 670 as now established, and 14th Street from the east line of Grand Boulevard to the west line of Oak Street as now established, and any existing right of way within a tract described as follows: Beginning at the southeast corner of Lot 148, Block 11, McGee's Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof; thence S 02 18'41" W along the southerly prolongation of the east line of said Lot 148, a distance of 12.00 feet to a point on the westerly prolongation of the south line of the north 12.00 feet of Lot I, Block 66, said McGee's Addition; thence N 87 44'09" W along said westerly prolongation, a distance of 94.12 feet; thence S 47 26'27" W, a distance of 53.45 feet to a point on the easterly prolongation of the south line of Lot 158, Block 12, said McGee's Addition; thence N 87 33'33" W along said prolongation, a distance of 66.00 feet to the southeast corner of said Lot 158; thence N 02 18'41" E along the east line of said Lot 158, a distance of 49.48 feet to the intersection of said east line with the westerly prolongation of the south line of Lot 148, said Block 11; thence S 87 44'09" E along said prolongation and south line of said Lot 148, a distance of 198.00 feet to the point of beginning; and all utility easements over, under, across and along said street, alleys and right of way within said described tract, all in Section 5, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri, be and the same is hereby vacated.

 

Section 4. That the City Clerk of Kansas City, Missouri, be and she is hereby authorized and directed to acknowledge this ordinance as deeds are acknowledged, and to cause this ordinance and the consent of property owners hereinbefore referred to, to be filed for record in the Recorder's Office in Jackson County, Missouri.


Section 5. All Ordinances or parts of Ordinances in conflict with this Ordinance are, in so much as they conflict with this Ordinance, hereby repealed.
