ORDINANCE NO. 051349

 

Approving an amendment to a previously approved development plan in District CP-2 on approximately 22.67 acres located at the southwest corner of N.E. Englewood Road and N. Oak Trafficway (Creekwood Commons). (9675-CP-19)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That an amendment to a previously approved development plan in District CP-2 (Local Planned Business Center) on approximately 22.67 acres located at the southwest corner of N.E. Englewood Road and N. Oak Trafficway (Creekwood Commons), and more specifically described as follows:

 

Tracts 1A & 1B, Creekwood Oaks, Third Plat, Kansas City, Clay County, Missouri

 

is hereby approved, subject to the following conditions:

 

1.                  That a 6 foot variance to the minimum required right-of-way width for a primary arterial with a bike path for N. Oak Trafficway so as to permit 50 feet of right-of-way from the centerline as shown on the development plan is hereby granted.

 

2.                  That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site to Development Services prior to approval and issuance of any building permits, and that the developer construct any improvements as required by Development Services.

 

3.                  That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to the commencement of any construction activities.

 

4.                  That the developer provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

5.                  That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, grading, signage (including elevations), building elevations for each structure per Staff approval, and lighting, including a photometric study.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
