COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 070035

 

Approving the preliminary plat of J.C. McCoy's Westport Replat on a 1.46 acre tract of land generally located at the south side of Westport Road between Mill Street and Pennsylvania Avenue. (SD 1300)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of J.C. McCoy's Westport Replat on a 1.46 acre tract of land generally located at the south side of Westport Road between Mill Street and Pennsylvania Avenue, and more specifically described as follows:

 

FIRST PLAT: Lots 21, 22 and 23, J. C. McCOY'S PLAT OF WESTPORT (sometimes known as McCOY'S PLAT OF WESTPORT, McCOY'S PART OF WESTPORT and McCOY'S ADDITION TO WESTPORT) and part of Lot 4, CAMPBELL'S ADDITION TO WESTPORT, all being subdivisions of land in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the Northwest corner of said Lot 21, said point being on the South right-of-way line of Westport Road and on the East right-of-way line of Pennsylvania Avenue, as said roads are now established; thence N 5535' E, along the North line of said Lots 21, 22 and 23, and along the South right-of-way line of said Westport Road, a distance of 222.12 feet, to the Northeast corner of said Lot 23, said point also being on the West right-of-way line of Broadway, as now established; thence S 3430' 46" E, along the East line of said Lot 23, and along the West right-of-way line of said Broadway, a distance of 141.94 feet, to the Southeast corner of said Lot 23, said point being on the North line of a 12 foot wide alley; thence S 5535' 14" W, along the South line of said Lots 23, 22 and 21, and along the North line of said alley, a distance of 222.04 feet, to the Southwest corner of said Lot 21, said point also being on the East right-of-way line of said Pennsylvania Avenue; thence N 3432' 42" W, along the West line of said Lot 21, and along the East right-of-way line of said Pennsylvania Avenue, a distance of 141.93 feet, to the point of beginning, containing 31,521 sq. ft., more or less.

 

SECOND PLAT: Lots 15, 16 and 17, J. C. McCOY'S PLAT OF WESTPORT (sometimes known as McCOY'S PLAT OF WESTPORT, McCOY'S PART OF WESTPORT and McCOY'S ADDITION TO WESTPORT), a subdivision of land in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the Northeast corner of said Lot 15, said point also being on the South right-of-way line of Westport Road, said point also being on the West right-of-way line of Pennsylvania Avenue, as said roads are now established; thence S 3432' 42" E, along the East line of said Lot 15, and along the West right-of-way line of said Pennsylvania Avenue, a distance of 143.58 feet, to the Southeast corner of said Lot 15, said point being on the North line of a 12 foot wide alley; thence S 5534' 06" W, along the South line of said Lots 15, 16 and 17, and along the North line of said alley, a distance of 223.88 feet, to the Southwest corner of said Lot 17, said point also being on the East right-of-way line of Mill Street, as now established; thence N 3430' 13" W, along the West line of said Lot 17, and along the East right-of-way line of said Mill Street, a distance of 143.64 feet, to the Northwest corner of said Lot 17, said point also being on the South right-of-way line of said Westport Road; thence N 5535' E, along the North line of said Lots 17, 16 and 15, and along the South right-of-way line of said Westport Road, a distance of 223.78 feet, to the point of beginning, containing 32,145 sq. ft., more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer secure approval from the Board of Zoning Adjustment for any necessary variances, if required.

 

3. That the developer secure permits to repair existing or reconstruct sidewalks, curbs, gutters, and alleys as necessary along all development street frontages, or submit a letter from a Missouri licensed civil engineer stating that the sidewalks, curbs, gutters, and alleys are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by Development Services, prior to recording the plat.

 

4. That the developer submit covenants, conditions and restrictions to Development Services for review by the Law Department for approval for the maintenance of any tracts.

 

5. That the minimum required lot width of 50 feet is hereby waived for proposed Lot 3 as shown on the preliminary plat

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
