COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 050409

 

Approving a preliminary development plan in District GPA on a 16.38 acre tract of land located at the northeast corner of Highway 150 and Peterson Road. (13097-GP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a preliminary development plan is approved in District GPA, (Longview Lake General Planned District, Agricultural) on a 16.38 acre tract of land located at the northeast corner of Highway 150 and Peterson Road, and more specifically described as follows:

 

 

A part of the Southeast Quarter of Section 28, Township 47, Range 32, Kansas City, Jackson County, Missouri described as follows:

 

Commencing at the Southwest corner of said Quarter Section; thence North 01 degrees 18 minutes 29 seconds West along the West line of said Quarter Section, 30.00 feet; thence North 88 degrees 41 minutes 31 seconds East, 25.00 feet to the Point of Beginning; thence North 01 degrees 18 minutes 29 seconds West along the East right of way line of Peterson Road, 891.29 feet; thence North 88 degrees 41 minutes 31 seconds East, 147.09 feet; thence South 45 degrees 27 minutes 45 seconds East, 124.76 feet; thence South 65 degrees 39 minutes 57 seconds East, 98.10 feet; thence North 60 degrees 15 minutes 02 seconds East, 86.49 feet; thence South 65 degrees 01 minutes 29 seconds East 258.64 feet; thence South 88 degrees 46 minutes 49 seconds East, 177.95 feet; thence South 21 degrees 44 minutes 13 seconds East, 97.45 feet; thence South 77 degrees 40 minutes 35 seconds East, 74.83 feet; thence South 01 degrees 18 minutes 36 seconds East, 571.26 feet to a point on the North right of way line of Missouri Route A (150 hwy) (Outer Belt Road); thence along said right of way line South 88 degrees 49 minutes 19 seconds West, 914.92 feet to the Point of Beginning. Containing 15.87 acres, more or less and subject to any easements.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro, micro storm drainage study to the City Engineers Office for approval and that the developer make any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer construct all-weather roads and provide for fire protection as required by the Fire Department prior to construction beyond footings and foundations.

 

7. That at the time of final platting the developer will enter into a secured agreement to extend sanitary sewers at such time that sanitary sewers are extended within 750 feet and accepted by Public Works, and the developer will construct said sewers within six months of being notified of said acceptance by Public Works.

 

8. That the developer dedicate 30 feet of right-of-way from centerline on the east side of Peterson Road.

 

9. That the developer improve the east half of Peterson Road to collector street standards, including curb, gutter and streetlights.

 

10. That the developer enter into a secured deferral agreement to construct sidewalks on the east side of Peterson Road within 2 years as required by the Department of Public Works.

 

11. That the developer submit a final plan to the City Plan Commission for approval, including a final site plan, elevation grading plan, landscaping plan, signage plan and lighting plan, including a photometric study showing 0 foot candles at the property lines.

 

12. That the developer show the limits of the 100 year floodplain on the final plat.

 

13. That the developer obtain any required grading consents, and all grading, construction and drainage and sewer easements from the abutting property owners prior to submitting any public improvements.

 

14. That the developer secure a permit from the Missouri Department of Transportation prior to working in State Highway right of way.

 

A copy of said plan is on file in the office of the City Clerk with this ordinance which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
