ORDINANCE NO. 041333
Authorizing the Director of Water
Services to expend $3,900,000.00 for the Turkey Creek tunnel modifications
being undertaken as part of the Turkey Creek Flood Control project in
cooperation with the U.S. Army Corps of Engineers and the Unified Government of
Wyandotte County and Kansas City, Kansas.
WHEREAS, by
Ordinance No. 63673, the City authorized a flood control feasibility study with
the U.S. Army Corps of Engineers for Turkey Creek; and
WHEREAS, by Resolution
Nos. 950301 and 990018, the City expressed its vigorous and continued support
of the Turkey Creek Flood Control Project and requested the U.S. Army Corps of
Engineers to accelerate the project; and
WHEREAS, by
Ordinance Nos. 990396 and 991508, the City entered into an agreement with the
U.S. Army Corps of Engineers to design the project and authorized $114,100.00
for the Citys Fiscal Year 1999-2000 cost share of the design of the Turkey
Creek Flood Damage Reduction Project; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of Water Services is hereby authorized to expend the sum of
$3,900,000.00 from funds previously appropriated to Account No.
05-3090-807203-B, Water Treatment Plant Improv, for the Citys share of the
construction costs for the Turkey Creek tunnel modifications being undertaken
as part of the Turkey Creek Flood Control project with the Department of the
Army, represented by the U.S. Corps of Engineers, and the Unified Government of
Wyandotte County and Kansas City, Kansas.

I hereby certify
that there is a balance, otherwise unencumbered, to the credit of the
appropriation to which the foregoing expenditure is to be charged, and a cash
balance, otherwise unencumbered, in the treasury, to the credit of the fund
from which payment is to be made, each sufficient to meet the obligation hereby
incurred.
