ORDINANCE NO. 080514

 

Determining that a public benefit will be gained by the waiver of a demolition lien on a property located at 900 E. 21st Street and authorizing the City Manager to waive the lien.

 

WHEREAS, Overland Investors, LLC, is under contract to purchase and renovate the Burge Ice Company located at 900 E. 21st Street at a total project investment of $415,000.00; and

 

WHEREAS, part of the Burge Ice Company facility was partially destroyed by fire and designated a dangerous building by the City of Kansas City, Missouri; and

WHEREAS, there exists a demolition lien against the property at 900 E. 21st Street which is owned by Joseph W. Burge in the amount of $440,844.42; and

 

WHEREAS, Overland Investors, LLC, has received preliminary approval of their Project Application and Redevelopment Contract through the Land Clearance for Redevelopment Authority, contingent upon the waiver of the demolition lien; and

 

WHEREAS, the demolition lien waiver committee recommends waiver of this lien; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That in accordance with Section 56-547(3), Code of Ordinances, the Council finds and determines that a public benefit will be gained by the waiver of the demolition lien on 900 E. 21st Street, namely: The proposed improvements will clear blight, enhance the opportunity for redevelopment and improve the economic viability of the area through the creation of new jobs.

 

Section 2. That in accordance with Section 56-547(1), Code of Ordinances, the City Manager is hereby authorized to waive the aforementioned demolition lien provided, however, that the lien shall not be waived until ownership of the property located at 900 E. 21st Street is transferred to Overland Investors, LLC, the renovation work of the property located at 900 E. 21st Street is completed, and a temporary certificate of occupancy is issued, and further directing that a development agreement be entered into between the City of Kansas City, Missouri and Overland Investors, LLC.
