ORDINANCE NO. 010597

 

Approving an amendment to a previously approved development plan in District GP-2 (General Transient Retail Business) on approximately an 80 acre tract of land generally located west of N. Congress Avenue, east of I-29, north of Tiffany Springs Parkway and approximately one-quarter mile south of N. 106th Street, for the purpose of deleting an approximately 9 acre tract of land from said development plan. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-2 (General Transient Retail Business) on approximately an 80 acre tract of land generally located west of N. Congress Avenue, east of I-29, north of Tiffany Springs Parkway and approximately one-quarter mile south of N. 106th Street, and more specifically described as follows:

 

All of Lots 2, 3, 5, 6, 7-Tract A, 7-Tract B, 8, 9 and 10, Executive Hills North 2nd Plat, a subdivision of land lying in Kansas City, Platte County, Missouri; and all of Lot 11, Executive Hills North - Lot 11, a subdivision of land lying in Kansas City, Platte County, Missouri; and all of Lot 4, Executive Hills North - Lot 4", a subdivision of land lying in Kansas City, Platte County, Missouri.

 

for the purpose of deleting therefrom an approximately 9 acre tract of land, more specifically described as follows:

 

All of Lot 6, Executive Hills North 2nd Plat, a subdivision lying in Kansas City, Platte County, Missouri.

 

so that the remaining tract of land of approximately 71 acres, more specifically described as follows:

 

All of Lots 2, 3, 5, 7-Tract A, 7-Tract B, 8, 9 and 10, Executive Hills North 2nd Plat, a subdivision of land lying in Kansas City, Platte County, Missouri; and all of Lot 4, Executive Hills North - Lot 4", a subdivision of land lying in Kansas City, Platte County, Missouri; and all of Lot 11, Executive Hills North - Lot 11", a subdivision of land lying in Kansas City, Platte County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

2. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 


3. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

6. That the developer extend water mains as required by the Water Services Department.

 

7. That the developer extend sanitary sewers as required by the Department of Public Works.

 

8. That the developer secure the approval of the Missouri Department of Transportation prior to working within any State right of way.

 

9. That the developer comply with the KCI Airport Height zoning restrictions as required by the Aviation Department.

 

10. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading, signage and building elevations.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 010597, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
