ORDINANCE NO. 100788

 

Authorizing the City Manager to execute a multi-party grant agreement with the U.S. Department of Transportation, Federal Transit Administration, to receive federal funding of the TIGER grant for the Green Impact Zone; authorizing the Director of Public Works to execute a cooperative agreement with the Kansas City Area Transportation Authority for the same grant; and recognizing an emergency.

 

WHEREAS, Committee Substitute for Resolution No. 090254, adopted April 2, 2009, established the City's policy on participation in the Green Impact Zone Initiative that will receive federal funding under the American Recovery and Reinvestment Act and directed the City Manager to implement the City's participation in the Green Impact Zone Initiative; and

WHEREAS, the Kansas City region’s TIGER grant application was awarded $50 Million by the U.S. Department of Transportation; and

  WHEREAS, part of that grant includes $26.5 Million in the Green Impact Zone for transit access improvements; and

 WHEREAS, the work within the Green Impact Zone to be funded by this grant relates to public improvements to be paid by federal funds and to contracts relating to the design, repair, maintenance or construction of such public improvements; and

WHEREAS, this grant will be used to improve sidewalks, install bus amenities, repave street surfaces near stop locations, and improve traffic signals all within the Kansas City, Missouri, Green Impact Zone; and

WHEREAS, as a condition of the TIGER grant process, the Federal Transit Administration (“FTA”) requires that the City sign the grant agreement along with the Kansas City Area Transportation Authority (“KCATA”); and

WHEREAS, as a condition of the TIGER grant process, the City must sign a cooperative agreement with the KCATA; NOW, THEREFORE:

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the City Manager is hereby authorized to execute the multi-party grant agreement with the FTA, and the Director of Public Works is hereby authorized to execute a cooperative agreement with the KCATA. Copies of each agreement are on file with the Director of Public Works and are hereby approved in substantial form.


Section 2. That this ordinance recognizes an emergency as provided in Section 503(a)(3)(D) of the Charter, and shall take effect in accordance with that provision.
