ORDINANCE NO. 100870

 

Approving the Troost-Rockhill PIEA General Development Plan for an area of approximately 15 acres generally bounded by 65th Street on the north, Troost Avenue on the east, a portion of Rockhill Road on the west, and declaring that area a blighted and insanitary area in need of redevelopment and rehabilitation pursuant to the Missouri Planned Industrial Expansion Authority Law. (683-S)

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri caused to be prepared the Troost-Rockhill PIEA General Development Plan and recommended that the Council approve the finding of blight and the General Development Plan for the area; and

WHEREAS, the City Plan Commission has reviewed and recommended approval of the finding of blight and of the Troost-Rockhill PIEA General Development Plan on September 21, 2010, as evidenced by its disposition of the case and its written recommendations submitted to the City on September 21, 2010; and

WHEREAS, the Council held a public hearing on the Troost-Rockhill PIEA General Development Plan, after the required public notices were given and all interested parties were afforded a reasonable opportunity to express their views respecting the proposed plan at the public hearing; and

 WHEREAS, the Council has reviewed the blight study for the Troost-Rockhill PIEA Planning Area; and

WHEREAS, Section 100.400, RSMo, authorizes the Council to make a finding that an area is a blighted area and approve a general development plan for such area if the Council finds that the plan is feasible and in conformity with the general plan for the development of the community as a whole; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Council finds the Troost-Rockhill PIEA Planning Area, which area contains approximately 15 acres generally bounded by 65th Street on the north, Troost Avenue on the east, a portion of Rockhill Road on the west, and is more specifically described by metes and bounds as follows:

Beginning at the northeast corner of Tract A, Baptist Medical Center, Second Plat, a subdivision in the City of Kansas City, Jackson County, Missouri; thence coincident with the East line of said Tract A along the following courses: South 02 degrees 22 minutes 56 seconds West, a distance of 304.89 feet; thence North 86 degrees 43 minutes 17 seconds West, 117.81 feet; thence South 02 degrees 22 minutes 42 seconds West, 255.27 feet; thence departing the east line of said Tract A, east along the South line of Lot 1, Dialysis Clinic Incorporated– First Plat, a subdivision in Kansas City, Jackson County, Missouri, parallel with the North line of the Southeast 1/4 of the Northeast 1/4 of the Southeast 1/4 of the Southeast 1/4 of Section 5, Township 48, Range 33, in Kansas City, Jackson County, Missouri, a distance of 127.27 feet; thence North along the East line of said Lot 1, Dialysis Clinic Incorporated – First Plat, a subdivision in Kansas City, Jackson County, Missouri , a distance of 192.75 feet to a point 62.50 feet South of the North line of said 1/4 1/4 1/4 1/4 Section; thence East and parallel to the North line of said 1/4 1/4 1/4 1/4 Section a distance of 157.39 feet to a point on the west right-of-way line of Troost Avenue, as now established; thence south along said west right-of-way line of Troost Avenue, as now established, to the southeast corner of Tract A, Baptist Medical Center, Second Plat, a subdivision in Kansas City, Jackson County, Missouri; thence North 86 degrees 43 minutes 43 seconds West, along the South line of said Tract A, a distance of 440.70 feet; thence South 02 degrees 19 minutes 33 seconds West continuing along said South line, a distance of 118.50 feet; thence North 86 degrees 43 minutes 43 seconds West, continuing along said South line, a distance of 150.00 feet; thence North 02 degrees 19 minutes 53 seconds East, continuing along said South line, a distance of 368.50 feet, to a point on the North line of the Northeast quarter of Section 8, Township 48, Range 33; thence South 86 degrees 43 minutes 13s seconds East, along said North line, a distance of 319.79 feet; thence North 02 degrees 12 minutes 17 seconds East, 345.57 feet; thence North 86 degrees 43 minutes 13 seconds West, 118.32 feet; thence North 01 degrees 50 minutes 23 seconds East, 67.82 feet; thence North 10 degrees 16 minutes 15 seconds East, 10.59 feet; thence North 25 degrees 08 minutes 34 seconds East, 11.45 feet; thence North 40 degrees 28 minutes 17 seconds East, 11.59 feet; thence North 58 degrees 32 minutes 49 seconds East, 10.85 feet; thence North 53 degrees 30 minutes 41 seconds East, 48.55 feet; thence North 40 degrees 18 minutes 43 seconds West, 455.39 feet to the West line of said Tract A; thence along a non-tangent curve to the left, coincident with the West line of said Tract A, 8.63 feet, said curve has a radius of 552.00 feet and a chord bearing North 32 degrees 19 minutes 43 seconds East, 8.63 feet to a point of a tangent compound curve; thence along said curve, to the left, coincident with the West line of said Tract A, 181.26 feet, said curve has a radius of 392.60 feet and a chord bearing North 18 degrees 39 minutes 17 seconds East, 179.66 feet to a point of non-tangent curve, as platted; thence along said non-tangent curve to the left, coincident with the West line of said Tract A, 100.00 feet, said curve has a radius of 540.00 feet and a chord bearing North 07 degrees 40 minutes 44 seconds East, 99.85 feet; thence North 02 degrees 22 minutes 26 seconds East, coincident with the West line of said Tract A, 162.51 feet to a point of curvature; thence along a curve to the right, coincident with the West line of said Tract A, 63.46 feet, said curve has a radius of 40.00 feet and a chord bearing North 47 degrees 49 minutes 34 seconds East, 57.01 feet to the North line thereof; thence North 86 degrees 43 minutes 17 seconds East, coincident with the North line of said Tract A, 365.03 feet to the point of beginning.

to be a blighted area as defined in Section 100.310, RSMo, and more specifically finds that there is a predominance of defective and inadequate street layout, insanitary and unsafe conditions, deterioration of site improvements, improper subdivision or obsolete platting, and the existence of conditions which endanger life and property by fire and other causes in such planning area and as a result of the predominance of those conditions the planning area in its present condition and use constitutes an economic and social liability and a serious menace to the public health, safety, morals, and welfare.

Section 2. That Troost-Rockhill PIEA General Development Plan is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole.

Section 3. That the Council has duly made the findings necessary for compliance with Section 100.300-100.620, RSMo.

Section 4. That a copy of the Troost-Rockhill PIEA General Development Plan is attached to this ordinance and is made a part hereof and is hereby approved subject to the following revisions:

 

1.                  Page 5: Revise plan boundary to reflect proposed planning area map.

 

2.                  Page 8: Provide legible map and legend identifying planning area.

 

3.                  Page 15: Revise map to reflect the planning area boundary on page 5.

 

4.                  Page 28/29: Provide standard abatement maximum as recommended by RCC.

 

5.                  Page 31: Change URD language to read that “rezoning to URD will be required for all redevelopment seeking PIEA abatement unless the developer follows the Department of the Interior Standards or rezoning is waived by the City Planning Department Director.”

 

6.                  Page 31: Revise to state that proposed land use changes must conform to adopted area plan.

 

7.                  Page 28: Add “Any parcel/parcels within the Plan boundaries that has/have previously received any amount of tax abatement under a previously approved abatement tool, shall at the time of the Preliminary Project Proposal Review, under the requirements of the ED&I Policy, identify the parcel/parcels within the project area of such abatement and determine whether that/those parcel/parcels are eligible for abatement.”

 

8.                  Add a consolidated metes and bounds legal description.

Section 5. That the ad valorem tax exemption benefits as authorized in Section 100.570, RSMo, may be extended to the plan area to the extent and in the manner as provided for in the General Development Plan, subject to the approval of the City Council in a separate action, and subject to the execution of a development agreement between the Planned Industrial Expansion Authority and the developer.
