ORDINANCE NO. 960322

 

Approving an amendment to a previously approved Community Unit Project on approximately a 86.3 acre tract of land generally located at the northwest corner of Lee's Summit Road and Little Blue Road. (10177-CUP-6)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved Community Unit Project on approximately a 86.3 acre tract of land generally located at the northwest corner of Lee's Summit Road and Little Blue Road, and more specifically described as follows:

 

All that part of the Northeast Quarter of Section 13, Township 48, Range 32 and all that part of the Northwest Quarter of Section 18, Township 48, Range 31, all in Kansas City, Jackson County, Missouri, described as follows: Commencing at the southeast corner of said Northeast Quarter; thence North 86 56'55" West along the south line of said Quarter Section and 20 feet north of and parallel to the centerline of Little Blue Road a distance of 790.33 feet to the true point of beginning; thence continuing North 86 56'55" West along said south line a distance of 1772.97 feet to the southwest corner of said section; thence North 01 47'15" East along the west line of said Quarter Section said west line being 20 foot distant and parallel to the centerline of Little Blue Road, a distance of 907.87 feet; thence South 86 51'51" East a distance of 1,043.55 feet; thence North 01 47'15" East a distance of 417.42 feet; thence North 86 51'51" West a distance of 895.45 feet; thence North 03 08'09" East a distance of 422.66 feet; thence South 86 51'51" East a distance of 1,209.20 feet; thence North 03 08'11" East a distance of 50.0 feet; thence South 86 51'51" East a distance of 270.00 feet; thence South 78 52'09" East a distance of 359.49 feet; thence South 86 51'51" East a distance of 145.20 feet; thence South 03 08'09" West a distance of 278.49 feet; thence South 86 51'51" East a distance of 655.79 feet to the centerline of Lee's Summit Road; thence South 07 09'34" West along said centerline a distance of 464.97 feet; thence North 88 03'45" West a distance of 208.10 feet; thence South 01 56'12" West a distance of 93.30 feet; thence South 86 51'53" East a distance of 30.01 feet; thence South 01 56'11" West a distance of 54.33 feet; thence South 88 03'46" East a distance of 164.55 feet to the centerline of Lee's Summit Road; thence South 06 20'47" West along said centerline a distance of 361.49 feet; thence continuing along said centerline on a bearing of South 07 03'27" West a distance of 132.19 feet; thence North 86 56'55" West a distance of 908.31 feet; thence South 03 03'05" West a distance of 360.00 feet to the point of beginning, containing 86.3 acres, except that part in street right of way.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval when the first plat is submitted and that the

developer make any improvements as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer submit conditions, covenants and restrictions to the Law Department for approval.

 

5. That the developer submit a street name sign plan for approval.

 

6. That the developer secure the approval of the Street Naming Committee for all street names.

 

7. That the developer install hard surface roads and provide for fire protection prior to construction beyond foundations.

 

8. That the developer construct temporary cul-de-sacs as required by the Department of Public Works for each phase.

 

9. That the developer extend water mains as required by the Water Services Department.

 

10. That the developer contribute $34,972.76 in lieu of parkland dedication for the 188 single family lots remaining to be platted in satisfaction of Section 66-128 of the

Subdivision Regulations; provided that the required contribution may be reduced for

private open space as shown on the preliminary plan. The developer has previously

contributed $6,699.48 for 48 single family lots.

 

11. That the developer obtain a land disturbance permit from the Missouri Department of Natural Resources.

 

12. That the developer dedicate additional right of way for Lee's Summit Road as required by the Department of Public Works so as to provide 40 feet of right of way

as measured from the centerline of Lee's Summit Road.

 

13. That the developer dedicate additional right of way for Gregory Boulevard (E/W portion of Little Blue Road) as required by the Department of Public Works so as to

provide 75 feet of right of way as measured from the centerline of Gregory

Boulevard (E/W portion of Little Blue Road).

 

14. That the developer dedicate additional right of way for Little Blue Road as required by the Department of Public Works so as to provide 30 feet of right of way as

measured from the centerline of Little Blue Road.

 

15. That the developer improve one-half of Gregory Boulevard to parkway street standards.

 

16. That the developer improve one-half of Lee's Summit Road to arterial street standards, including the frontage along the property directly north of proposed E.

77th Terrace, as shown on the preliminary plan.

 

17. That the developer improve one-half of Little Blue Road to collector street standards.

 

18. That the developer submit a street tree planting plan as part of the final plat and secure the approval of the City Forester for street trees planted on right of way.

 

A copy of said Community Unit Project amendment is on file in the office of the City Clerk under Document No. 960322, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
