Approving a Community Unit Project on an
approximately 13.19 acre tract of land generally located on the east side of N.
Gower Drive, north of N.W. 66th Terrace. (12197-CUP-1)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That a Community Unit
Project on an approximately 13.19 acre tract of land generally located on the
east side of N. Gower Drive, north of N.W. 66th Terrace, and more specifically
described as follows:
All that part of the
Southwest Quarter of Section 21, Township 51, Range 33 in the City of Kansas
City, Platte County, Missouri, described as follows: Commencing at the
northwest corner of the Southwest Quarter of said Section 21; thence South
0036'57" West, along the west line of the Southwest Quarter of said
Section 21, a distance of 314.32 feet; thence South 8923'03" East, a
distance of 702.09 feet to the point of beginning of the tract of land herein
to be described; thence South 0036'57" West, a distance of 114.14 feet;
thence South 8929'07" East, a distance of 340.00 feet; thence South
0036'57" West, a distance of 112.22 feet; thence South 8933'39"
East, a distance of 246.48 feet to the centerline of N. Mayview Road; thence
southerly along the centerline of said N. Mayview Road, along a curve to the
left having an initial tangent bearing of South 3046'12" West and a
radius of 195.00 feet, an arc distance of 90.12 feet; thence continuing along
said centerline South 0417'26" West, a distance of 100.59 feet; thence
southerly continuing along said centerline along a curve to the right being
tangent to the last described course, having a radius of 150.00 feet, an arc
distance of 19.35 feet; thence southerly continuing along said centerline along
a reverse curve to the left, having a radius of 182.04 feet, an arc distance of
119.37 feet; thence continuing along said centerline South 2553'31" East,
a distance of 32.23 feet; thence southerly continuing along said centerline,
along a curve to the right being tangent to the last described course having a
radius of 246.00 feet, an arc distance of 112.69 feet; thence continuing along
said centerline, South 0021'18" West, a distance of 48.98 feet; thence
North 8938'42" West, a distance of 1087.40 feet, to a point on the
easterly right of way line of Gower Road; thence North 1758'14" East,
along the easterly right of way line of said Gower Road, a distance of 371.43
feet; thence northeasterly continuing along said line, along a curve to the
right being tangent to the last described course, having a radius of 950.00
feet, an arc distance of 268.92 feet; thence northeasterly along a curve to the
right, having an initial tangent bearing of North 5753'34" East, and a
radius of 634.15 feet, an arc distance of 42.64 feet; thence North
6144'42" East, a distance of 247.74 feet to the point of beginning. Said
tract of land contains 13.19 acres, more or less.
is hereby approved, subject to the following
conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval at such time as the first final plat is
submitted and that the developer construct any necessary improvements as
required by the City Engineers Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineer's Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
5. That
the developer install hard surface roads and provide for fire protection as
required by the Fire Department prior to construction beyond foundations.
6. That
the developer extend water mains as required by the Water Services Department.
7. That
the developer submit a street tree planting plan as part of the final plat and
secure the approval of the City Forester for street trees planted on right of
way in front of residential lots, with a copy to be submitted to the Department
of City Development. The plan shall include size, type, species and placement
of trees.
8. That
the developer submit a street name signage plan to the Street Naming Committee
for approval.
9. That
the developer dedicate right of way for N. Mayview/Dagget Road so as to provide
50 feet of right of way for N. Mayview/Dagget Road as required by the
Department of Public Works.
10. That
the developer improve the west side of N. Mayview/Dagget Road to provide a
minimum pavement width of 20 feet plus the construction of curb, gutter and
sidewalks and the installation of streetlights as required by the Department of
Public Works.
11. That
the developer dedicate right of way for relocated N. Gower Drive as required by
the Department of Public Works so as to provide 120 feet of right of way for N.
Gower Drive.
12. That
the developer enter into a Cooperative Agreement with the City as required by
the Department of Public Works whereby the developer agrees to contribute the
sum of $114,570.00 (based on a rate of $134.00 per front foot times 855 feet)
for the improvement of N. Gower Drive.
13. That
the developer submit a Certificate of Survey to the Department of City
Development for approval prior to sale of individual units.
14. That
the developer contribute $7,854.17 in lieu of parkland dedication for 6 duplex
units and 52 three-plex and four-plex units in satisfaction of Section 66-128
of the Subdivision Regulations.
15. That
the developer explore the possibilities of any archeological resource sites
within the Community Unit Project area and comply with any federal, state or
local laws regarding any found archeological resource sites.
A copy of said Community Unit Project plan is on
file in the office of the City Clerk under Document No. 981453, which is
attached hereto and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed Community Unit
Project hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
