ORDINANCE NO. 081059

 

Approving the preliminary plat of 1715 Summit Condominiums on a 0.24 acre tract of land generally located on the east side of Summit Street just south of 17th Terrace. (SD 1399)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of 1715 Summit Condominiums on a 0.24 acre tract of land generally located on the east side of Summit Street just south of 17th Terrace, and more specifically described as follows:

 

All that part of Lots 2,3 and 4, Block 1, Merriam Place, a subdivision in Kansas City, Jackson County, Missouri, more particularly described as follows: Commencing at the Southwest corner of said Lot 4; thence North 02 degrees 43 minutes 46 seconds East along the West line of said Lot 4 a distance of 33.00 feet to the Point of Beginning; thence continuing North 02 degrees 43 minutes 46 seconds East along the West line of said Lots 4, 3 and 2 a distance of 77.00 feet to a point lying 10.00 feet North of the Southwest corner of said Lot 2 as measured along the West line of said Lot 2; thence South 87 degrees 27 minutes 22 seconds East along a line 10.00 feet North of and parallel to the South line of said Lot 2 a distance of 134.75 feet to a point lying 10.00 feet North of the Southeast corner of said Lot 2; thence South 02 degrees 43 minutes 46 seconds West along the East line of said Lots 2, 3 and 4 a distance of 77.00 feet to a point lying 33.00 feet North of the Southeast corner of said Lot 4; thence North 87 degrees 27 minutes 22 seconds West along a line lying 33.00 feet North and parallel to the South line of said Lot 4 a distance of 134.75 feet to the Point of Beginning. Containing 10,376 square feet or 0.24 acres.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer submit a letter from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, stating the condition of the sidewalks, curbs, and gutters. The letter must identify state of repair as defined in Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters. It shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages, as required by Development Services, prior to recording the plat.

 

3.                  That the developer submit covenants, conditions and restrictions to Development Services for approval by the Law Department for the maintenance of common elements.

 

4.                  That the developer pay $1,008.90 for 7 multifamily units in lieu of parkland dedication prior to recording the final plat in satisfaction of Section 66-128 of the Subdivision Regulations.

(for City Plan Commission). That a x ft. variance to the minimum required right-of-way width of 50 ft. for a minor (local residential) street so as to permit 40 ft. of right-of-way as shown on the development plan is hereby granted.

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
