ORDINANCE NO. 050467, AS AMENDED

 

Authorizing the Director of Public Works to execute a $32,819,000.00 Construction Contract with Clarkson Construction Company for the purpose of providing funds for the Convention Center Ballroom excavation, foundation and structure construction; authorizing the expenditure of previously appropriated funds in the amount of $34,459,950.00 therefore; and directing the City Clerk to file the Construction Contract in the office of the Secretary of State and in the office of the Recorder of Deeds for Jackson County, Missouri.

 

WHEREAS, the next phase of the Bartle Hall project calls for the expansion of the Ballroom Facility; and

 

WHEREAS, the expansion of the Ballroom Facility requires the construction of a structure over Interstate 670; and

 

WHEREAS, the accelerated construction schedule and project complexity demands a unique contract procurement process; and

 

WHEREAS, the bid package contained project allowances in the amount of $17,844,000.00 to be competitively bid by the general contractor when plans and specifications are finalized; and

 

WHEREAS, Clarkson Construction Company's bidding of the project allowances shall conform, in all respects, with the City's adopted contract procurement practices; and

 

WHEREAS, the Clarkson Construction Company's bid of $32,819,000.00, was the result of a sealed, unrestrictive, and competitive bidding process; and

 

WHEREAS, Sec. 70.220 R.S.Mo. authorizes any municipality to contract and cooperate with any private person, firm, association or corporation, for the planning, development, construction, acquisition or operation of any public improvement or facility; and

 

WHEREAS; the subject and purpose of this Construction Contract is within the scope of the powers of the City; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Public Works is hereby authorized to execute a Construction Contract, on behalf of the City, with Clarkson Construction Company in an amount not to exceed $32,819,000.00 for the purpose of constructing the Bartle Hall Convention Center Ballroom Expansion generally located over Interstate 670. A copy of the Construction Contract, in substantial form, is attached hereto and is hereby approved.

 

Section 2. That the work shall be done in accordance with the plans, specifications, and the Construction Contract between Kansas City, Missouri, through its Director of Public Works, and Clarkson Construction Company, in the amount of $32,819,000.00.

 

Section 3. That the Director of Public Work is authorized to expend the sum $11,600,000.00 for Construction Contract Allowance No. 1 regarding the installation all structural steel and appurtenances.

 

Section 4. That the Director of Public Works is authorized to expend the sum of $3,706,000.00.00 for Construction Contract Allowance No. 2 regarding the installation of precast concrete structural components.

 

Section 5. That the Director of Public Works is authorized to expend the sum of $1,500,000.00 for Construction Contract Allowance No. 3 regarding the installation of cast in place concrete decks.

 

Section 6. That the Director of Public Works is authorized to expend the sum of $1,038,000.00 for Construction Contract Allowance No. 4 regarding the installation of roadway lighting.

 

Section 7. That the City, in its sole discretion, shall determine the lowest and best bidder for Construction Contract Allowance No. 1, No. 2, No. 3 and No. 4.

 

Section 8. That the Director of Public Works is hereby authorized to expend the sum of $34,459,950.00 from funds heretofore appropriated to Account No. AL-3401-897240-B for the aforementioned Construction Contract and contingencies related thereto.

 

Section 9. That the City Clerk is hereby directed to file copies of this ordinance, together with the Construction Contract, in the office of the Secretary of State of Missouri and in the office of the Recorder of Deeds for Jackson County, Missouri, together with all other relevant documents.

 

Section 10. The Construction Contract shall not be executed or become effective until the City receives Federal Highway Administration approval to execute the Construction Contract and then proceed with the contract work

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
