COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 091064

Estimating and appropriating $775,751.48 in the General Fund; authorizing the Director of General Services to enter into a $5,983,585.00 contract with Johnson Controls for energy conservation measures in various City buildings; authorizing the Director of General Services to expend up to $6,000,000.00 for the Energy Conservation Project #1 and authorizing the Director of Finance to return unexpended appropriations to the appropriate account.

WHEREAS, the Council has adopted Resolution No. 060880 directing the City Manager to take all actions necessary to implement energy performance within departments to reduce energy costs at City-owned facilities; and

 

WHEREAS, the Council has adopted Resolution No. 070750 which recommends implementation of further energy conservation performance contracts to reduce energy and operation costs; and

 

WHEREAS, the Council adopted Resolution No. 080976 directed the Director of General Services Department to issue an RFP to four Energy Service Companies (ESCOs) selected through a nation-wide competitive RFP process for Energy Conservation Project #1; and

 

WHEREAS, the Council adopted Resolution No. 090356 declared the City Councils intent to utilize funds appropriated by the American Recovery and Reinvestment Act of 2009 for the United States Department of Energy Efficiency and Conservation Block Grant (EECBG) Program for the purposes of Energy Conservation Project #1; and

 

WHEREAS, the Energy Conservation Project #1 was awarded $1,663,000.00 from the total City’s EECBG allocation; and

 

WHEREAS, the City Manager has allocated $1,000,000.00 in the FY2009-10 Budget to support energy upgrades and efficiency projects to begin May 1, 2009;

NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That revenue is estimated in the following account of the General Fund:

 

10-1000-120000- 486250 Property Insurance Reimbursement $ 775,751.48

 

Section 2. That $775,751.48 is appropriated from the Unappropriated Fund Balance of the General Fund to the following account of the General Fund:

 

10-1000-077700-B-07000245 Fixed Plant Operations $ 775,751.48

Section 3. That the Director of General Services is authorized to execute, on behalf of Kansas City, Contract No. EV00000592, in the amount of $6,000,000.00 with Johnson Controls to implement the concepts and energy conservation measures for City buildings as outlined in the Energy Conservation Project #1 plan. A copy of the contract is on file in the office of the Director of General Services.

 

Section 4. That the Director of General Services is authorized to expend up to the sum of $6,000,000.00, including contingencies, from funds previously appropriated in the General Fund, No. 1000, ARRA Fund, No. 2530, and the Capital Improvement Fund, No. 3090, and from funds to be appropriated in the 2010-11 FY Budget in the Capital Improvement Fund as follows:

Section 5. The Director of Finance is hereby authorized to return the unexpended portion of this appropriation to the appropriate account.

I hereby certify that there is a balance in the amount of $4,972,517.48 otherwise unencumbered, to the credit of the appropriation to which a portion of the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet a portion of the obligation hereby incurred. I further certify that on May 1, 2010, pursuant to Committee Substitute for Ordinance No. 100191, as amended, there will be a balance in the amount of $1,027,482.52, otherwise unencumbered, to the credit of the appropriation to which the remainder of the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the remaining portion of the obligation hereby incurred.
