Rezoning an approximately 376.86 acre tract of land generally located along N.W. 132nd Street between N. Winan Avenue and N. Mexico City Avenue from Districts M2-3 and B3-3 to AG-R. (CD-CPC-2019-00084)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1207 , rezoning an approximately 376.86 acre tract of land generally located along N.W. 132nd Street between N. Winan Avenue and N. Mexico City Avenue from Districts M2-3 (Manufacturing 2) and B3-3 (Community Business) to AG-R (Agricultural-Residential), said section to read as follows:

 

Section 88-20A1207. That an area legally described as:

 

A tract of land in the Northeast Quarter, Southeast Quarter and Southwest Quarter of Section 10 Township 52 North, Range 34 West of the 5th Principal Meridian in Kansas City, Platte County, Missouri being bounded and described as follows: Commencing at the Northeast corner of said Northeast Quarter, (said point also being the Southwest corner of Southwest Quarter of Section 2, Township 52 North, Range 34 West, said point being noted for reference purposes only); thence South 89 degrees 49 minutes 32 seconds West, along the North line of said Northeast Quarter, 35.00 feet to the point of beginning of the tract of land to be herein described, said point being on the Westerly right of way line of Missouri State Route O (N. Winan Road) as established by Document 28603, in Book 195, at page 329; thence South 00 degrees 33 minutes 24 seconds West, along said Westerly right of way line, 396.36 feet; thence South 00 degrees 37 minutes 24 seconds West, along said Westerly right of way line, 1,642.56 feet; thence South 00 degrees 39 minutes 24 seconds West, 766.59 feet to a point on the Northerly right of way line of N.W. 132nd Street as established by Document No. 49132, in Book 711, at page 502; thence continuing South 00 degrees 39 minutes 24 seconds West along said Westerly right of way line, 80.01 feet to a point on the Southerly right of way line of said N.W. 132nd Street as established by said Document No. 49132, in Book 711, at page 502; thence continuing South 00 degrees 39 minutes 24 seconds West along said Westerly right of way line, 47.78 feet; thence South 00 degrees 04 minutes 24 seconds West along said Westerly right of way line, 5.08 feet; thence South 02 degrees 56 minutes 09 seconds West along said Westerly right of way line, 100.12 feet; thence South 00 degrees 14 minutes 24 seconds West along said Westerly right of way line, 249.50 feet; thence South 02 degrees 04 minutes 21 seconds East along said Westerly right of way line, 100.12 feet; thence South 00 degrees 47 minutes 24 seconds West along said Westerly right of way line, 812.26 feet; thence South 00 degrees 35 minutes 24 seconds West along said Westerly right of way line, 1,098.16 feet to a point on the South line of the Southeast Quarter of said Section 10, said point also being the Northeast corner of Solid Rock Ministries, a subdivision of land in said Kansas City, Platte County, Missouri; thence North 89 degrees 53 minutes 55 seconds West, along the South line of said Southeast Quarter and along the North line of said subdivision plat, 1994.26 feet to the Northwest corner of said subdivision plat and a point on the Northeasterly right of way line of Interstate Highway No. 29 as established by Section 15.10 of the Report of Commissioners, Case No. C-74-571, recorded August 14, 1975 in Book 470 at Page 105; thence North 68 degrees 15 minutes 09 seconds West along said Northeasterly right of way line, 627.99 feet to a point on the West line of the Southeast Quarter of said Section 10 and on the East line of the Southwest Quarter of said Section 10; thence continuing North 68 degrees 15 minutes 09 seconds West along said Northeasterly right of way line, 40.61 feet; thence North 55 degrees 59 minutes 59 seconds West along said Northeasterly right of way line, 900.00 feet; thence North 57 degrees 11 minutes 32 seconds West along said Northeasterly right of way line, 738.20 feet; thence North 53 degrees 50 minutes 15 seconds West along said Northeasterly right of way line, 253.46 feet a point on the Easterly right of way line of Mexico City Avenue as established by Section 15.09 of the Report of Commissioners, Case No. C-74-571, recorded August 14, 1975 in Book 470 at page 105; thence North 08 degrees 50 minutes 45 seconds East along said Easterly right of way line, 1030.51 feet; thence North 05 degrees 28 minutes 00 seconds East along said Easterly right of way line, 110.27 feet to the Southwest corner of a triangle shaped tract of land recorded July 28, 2011 as Document No. 2011008427, in Book 1176, at page 853; thence North 62 degrees 00 minutes 59 seconds East along the Southeasterly line of last said tract of land, 80.00 feet; thence North 34 degrees 54 minutes 56 seconds East along the Southeasterly line of last said tract of land, 73.04 feet to a point on the Southeasterly right of way line of said Mexico City Avenue as established by General Warranty Deed recorded November 18, 1997 as Document 49133, in Book 711 at page 503; thence North 89 degrees 27 minutes 30 seconds East along said Southeasterly right of way line of Mexico City Avenue as established by the last said right of way document, 110.53 feet; thence North 00 degrees 32 minutes 30 seconds West along said Southeasterly right of way line of Mexico City Avenue per the last said right of way document, 20.00 feet to a point on the Southerly right of way line of N.W. 132nd Street as established by aforesaid Document 49132, in Book 711 at page 502, said line also being 80.00 feet Southerly of and parallel with the North line of the Southwest Quarter of said Section 10; thence North 89 degrees 27 minutes 30 seconds East, along said Southerly right of way line and along said parallel line, 1227.97 feet to a point on the East line of the Southwest Quarter of said Section 10 and on the West line of the Southeast Quarter of said Section 10; thence North 00 degrees 15 minutes 54 seconds East, along last said West and East lines, 80.01 feet to the Center of said Section 10; thence North 00 degrees 28 minutes 01 seconds East, along the West line of the Northeast Quarter of said Section 10, 2648.03 feet to the Northwest corner of the Northeast Quarter of said Section 10; thence North 89 degrees 49 minutes 32 seconds East, along the North line of said Northeast Quarter, 2601.89 feet to the point of beginning. Containing 16,416,162 square feet or 376.86 acres, more or less.

 

is hereby rezoned from Districts M2-3 (Manufacturing 2) and B3-3 (Community Business) to AG-R (Agricultural-Residential), all as shown outlined on a map marked Section 88-20A1207, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
