ORDINANCE NO. 071355

 

Approving a preliminary Community Unit Project in District R-4 on approximately a 2.39 acre tract of land generally located on the west side of Holly Street at 44th Street. (11470-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a preliminary Community Unit Project in District R-4 (Low Apartments) on approximately a 2.39 acre tract of land generally located on the west side of Holly Street at 44th Street, and more specifically described as follows:

 

Phase 1: Holly Condominium. A part of Lots 13, 14, 15 Vogel Homestead, and Lots 106 and 107, Resurvey of Lots 10 to 12 & 27 to 32 both inclusive Vogel Homestead and the Pedestrian Way between Lots 13 and 107, all lying East of a line drawn 110.00 feet West of and parallel to the East line of said lots in Vogel Homestead, subdivisions in Kansas City, Jackson County, Missouri.

 

Phase 2: Wellington Condominium. Lots 108 and 109 and that part of Lot 110, lying South of the North line of Lot 107 produced West to the intersection of the South line of said Lot 110, all being in the Resurvey of Lots 10, 11, 12, 27, 28, 29, 30, 31, and 32, Vogel Homestead; all of Lot 26, Vogel Homestead, except the Southeasterly 8 feet thereof; that part of Lot 13 and 14, Vogel Homestead, and Lot 107, Resurvey of Lots 10, 11, 13, 27, 28, 29, 30, 31, and 32, Vogel Homestead, lying West of a line drawn 110 feet West of and parallel to the East line of said lots, except the Southeasterly 8 feet of the above described portion of Lot 14, and all the vacated pedestrian way lying South of and adjoining Lot 109 and that part of Lot 107 described above, Resurvey of Lots 10, 11, 12, 27, 28, 29, 30, 31 and 32, Vogel Homestead, all being in Kansas City, Jackson County, Missouri.

 

Lot 22, except the Southeasterly 11 feet and all of Lots 23, 24, 25 and the Southeasterly 8 feet of Lot 26, Vogel Homestead and the Southeasterly 8 feet of that part of Lot 14, Vogel Homestead, lying West of a line drawn 110 feet West of and parallel to the East line of said Lot 14, all being in Kansas City, Jackson County, Missouri.

 

The Southeasterly 11 feet of Lot 22, all of Lot 21 and Lot 19, except the Southerly 40 feet thereof, Vogel Homestead, a subdivision in Kansas City, Jackson County, Missouri.

 

All of Lot 20, and the Southerly 40 feet of Lot 19, Vogel Homestead, a subdivision in Kansas City, Jackson County, Missouri.

 

Lot 18 and the South 17 feet of Lot 17, Vogel Homestead, a subdivision in Kansas City, Jackson County, Missouri.

 

All of Lot 16 and Lot 17, except the South 17 feet thereof, Vogel Homestead, a subdivision in Kansas City, Jackson county, Missouri.

 

Phase 3: Mercier Condominium. All that part of Lot 112, lying South of the Westerly prolongation on the North line of Lot 105, all of Lot 111, that part of Lot 110 lying North of the Westerly prolongation of the South line of Lot 106, and all that part of Lot 106 lying West of a line drawn 110 feet West of and parallel with the East line of said Lot 106, all in the Resurvey and Subdivision of Lot 10 to 12 and 27 to 32, both inclusive, Vogel Homestead, a subdivision in Kansas City, Jackson County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2.                  That the developer secure permits to repair existing or reconstruct sidewalks, curbs, gutters, storm sewers, and streetlights as necessary along all development street frontages, or submit a letter from a Missouri licensed civil engineer stating that the sidewalks, curbs, and gutters are in a good state of repair and meet the requirements set forth in Chapters 56 and 64, Code of Ordinances, as required by Development Services, prior to recording the plat.

 

3.                  That the developer submit covenants, conditions and restrictions to Development Services for review by the Law Department for approval for the maintenance of common elements and private open space tracts.

 

4.                  That the developer secure the approval of the Board of Zoning Adjustment for any required variances

 

5.                  That the developer provide a shared access agreement prior to recording of the final plat.

 

6.                  That the developer contribute $8,518.92 in lieu of parkland dedication in satisfaction of Section 66-128 of the Subdivision Regulations, prior to recording of the final plat

 

7.                  That the developer submit a final community unit project plan to the City Plan Commission for approval including plans for landscaping, grading, signage, screening, berming, fencing, and a photometric study, showing zero footcandles at the property line.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
