ORDINANCE NO. 051086

 

Authorizing the Director of Finance to execute a Quit Claim Deed, deeding approximately 1 (one) acre of land to Jackson County, Missouri, in exchange for two Warranty Deeds for a total of approximately 1.06 acres Jackson County Property needed as part of the replacement of the Little Blue Road Bridge over Little Blue River, and directing the City Clerk to file this ordinance and attached deeds

 

 

Said Quit Claim Deed conveying the following property:

A strip of land in the Northwest one quarter of Section 9, Township 47 North, Range 33 West, in Kansas City, Jackson County, Missouri, being 100 feet in width and lying 50 feet on each side of the following described centerline: commencing at the Northwest corner of Section 9, T47N, R33W: thence S8752'35"E along the North line of the Northwest one quarter of said Section 9, a distance of 1,323.63 feet to the Northwest corner of the Northeast one quarter of the Northwest one quarter of said Section 9; thence S0314'33"W along the West line of the Northeast one quarter of the Northwest one quarter of said Section 9, a distance of 659.14 feet to the Northwest corner of the Southwest one quarter of the Northeast one quarter of the Northwest one quarter of said Section 9; thence S8751'14"E along the North line of the Southwest one quarter of the Northeast one quarter of the Northwest one quarter of said Section 9, a distance of 160.67 feet to the point of intersection with the Westerly right-of-way line of the abandoned Missouri Pacific Railway as shown in Missouri Pacific Railway Company Right-of-Way and Tract Map, Number V9MO-5, dated May 15, 1939, and the Easterly right-of-way line of the Missouri Pacific Railway Company as recorded in Book 4759, at Page 217; thence N8440'28"E, a distance of 50.00 feet to a point on the centerline of the Missouri Pacific Railway Company Right-of-Way as shown on the Missouri Pacific Railway Company Right-of-Way and Tract Map Number V9MO-5, dated May 15, 1939, being a point on a curve of a non-tangent curve to the left having a central angle of 0252'28" and a radius of 7,161.44 feet, the radius point bears N8440'28"E; thence Southeasterly along the arc of that curve and along that centerline a distance of 359.27 feet to a point of compound curve of a curve to the left having a central angle of 1721'19" and a radius of 1,145.91 feet; thence Southeasterly along the arc of that curve a distance of 347.11 feet to the point of curve of a curve to the left having a central angle of 1250'40" and a radius of 1145.91 feet, said point being the point of beginning of the herein described tract of land; thence southeasterly along the arc of that curve a distance of 256.89 feet to the point of tangent; thence S3824'00"E, a distance of 123.50 feet to a point of curve of a curve to the right having a central angle of 0329'48" and a radius of 904.63 feet; thence Southerly along the arc of that curve, a distance of 55.21 feet, to the point of terminus. the outer limits of this tract shall be lengthened or shortened as to terminate on adjoiners property lines.

 

Containing 1.00 Acres

 

WHEREAS, the Council finds that for the public good, it is deemed necessary that the Little Blue Road Bridge over the Little Blue River be replaced; and

 

WHEREAS the Council finds that the Director of Public Works, as evidenced by his Declaration of Necessity No. 5298 adopted and entered June 15, 2004, has caused the plans and specifications for said improvement to be prepared and it also determined that certain lands and easements must be acquired in connection with the making of the improvement declared necessary; and

 

WHEREAS, the Council finds that the City needs to obtain two small tracts of land, totaling approximately 1.06 acres of Little Blue Trace property from Jackson County as part of the bridge replacement. The Little Blue Trace carries a restriction from the National Parks Service that requires property of at least equal value be provided as replacement for that which is taken. The City is offering a tract of approximately one (1) acre of land as replacement property, which has equal value to the 1.06 acres being obtained from the County. The National Parks Service has reviewed the exchange and approved it as meeting the requirements of the Land and Water Conservation Fund Section 6(f)(3); NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Finance be, and is hereby authorized and directed to execute a Quit Claim Deed, deeding approximately one (1) acre of land, situated near Martha Truman Road and Troost Avenue, in Kansas City, Jackson County, Missouri, in exchange for two (2) General Warranty Deeds for 1.06 acres of Jackson County property needed as part of the replacement of the Little Blue Road Bridge over Little Blue River, copies of which are attached hereto and incorporated herein by reference.

Section 2. That the City Clerk is hereby directed to file copies of this ordinance, together with the Warranty Deeds, in the office of the Secretary of the State of Missouri and in the office of the Recorder of Deeds of Jackson County, Missouri, together with all other relevant documents.
