ORDINANCE NO. 051210

Approving a first amendment to the general development plan for the Truman Road Business Park Area, by expanding the area to include an area to the north roughly bounded by the Kansas City Terminal Railway on the south, Spruce Avenue on the west, Cloon Avenue on the north, and Elmwood Avenue on the east. 

WHEREAS, the Planned Industrial Expansion Authority of Kansas City, Missouri (the Authority) prepared or cause to be prepared a General Development Plan for the Truman Road Business Park Area generally bounded by Truman Road on the south, Cleveland Avenue on the west, the Kansas City Belt Railroad on the north, and a line approximately 1450 feet west of Van Brunt Boulevard on the east, and recommended that the Council approve the finding of blight and approve the General Development Plan for the area; and

WHEREAS, the Council, by passage of Ordinance No. 010638, approved a general development plan for the Truman Road Business Park Area; declared the area described therein to be a blighted, insanitary or an undeveloped industrial area and its redevelopment necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare; and approved ad valorem tax benefits pursuant to Section 100.570, RSMo; and

WHEREAS, on July 22, 2005, by adoption of Resolution No. 1005, the Authority approved an amendment to the Truman Road Business Park General Development Plan which expanded the boundaries of the Truman Road Business Park Area to include an area on the north generally bounded by the Kansas City Terminal Railway on the south, Spruce Avenue on the west, Cloon Avenue on the north, and Elmwood Avenue on the east; and

WHEREAS, the City Plan Commission reviewed and recommended approval of the amendment to the General Development Plan for the Truman Road Business Park Area on September 20, 2005, and has found said plan to be in conformance with the general plan for the development of the community as a whole; and

WHEREAS, the Council desires to amend the general development plan for the Truman Road Business Park Area; NOW, THEREFORE

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the General Development Plan for the Truman Road Business Park Area is hereby amended to include certain tracts of land north generally bounded by the Kansas City Terminal Railway on the south, Spruce Avenue on the west, Cloon Avenue on the north, and Elmwood Avenue on the east, so that the Truman Road Business Park Area, as amended, shall consist of the following tracts of land:

 

28-220-33-24-00-0-00-000 (4322 E. 12th Street):

Part of the SW of the NW of Section 2, Township 49N, Range 33W described as follows: Beginning on the North line of 12th Street at a point 484 feet East of the West line of said Quarter Quarter Section, thence North 300 feet, thence East 220 feet, thence South 300 feet, thence West 220 feet to the point of beginning, all in Kansas City, Jackson County, Missouri.

 

28-220-33-37-00-0-00-000 (1150 Elmwood Avenue):

Part of the SW of the NW of Section 2, Township 49N, Range 33W described as follows: Beginning at the intersection of the North line of 12th Street with the Northerly line of Elmwood Avenue Diversion 759 feet East of the West line of said Quarter Quarter Section, thence Northeasterly along the Northerly line of Elwood Avenue Diversion 275.4 feet to a point 270.72 feet Southwesterly of the West line of Elmwood, thence Northerly 216.57 feet to a point 253.90 feet West of the West line of Elmwood, thence West 290.99 feet, thence Southeasterly to the point of beginning, all in Kansas City, Jackson County, Missouri.

Part of the SW of the NW of Section 2, Township 49N, Range 33W described as follows: Beginning on the Northerly line of Elmwood Avenue Diversion 174.2 feet Southwesterly of the West line of Elwood Avenue, thence North 182.79 feet to a point 313 feet North of the North line of 12th Street and 165 feet West of the West line of Elmwood Avenue, thence West 89.89 feet, thence South 216.57 feet to the Northerly line of Elmwood Diversion, thence Northeasterly along said Northerly line 96.51 feet to the point of beginning, all in Kansas City, Jackson County, Missouri.

Lots 3-15, MAPLE GROVE, a subdivision in Kansas City, Jackson County, Missouri.

AND

All of vacated 11th Street lying South of and adjacent to Lots 9-11 and the East half of Lot 12 in MAPLE GROVE, a subdivision in Kansas City, Jackson County, Missouri.

AND

An irregular tract described as follows: Beginning on the North line of 12th Street at a point 704 East of the West line of Section 2, thence North 300 feet, thence West along the East line of Lots 8 and 9, MAPLE GROVE, to the North line of said subdivision, thence East 425 feet, thence South 349.42 feet, thence West 233.39 feet, thence South 305 feet (more or less) to the North line of 12th Street, thence West along the said North line to the point of beginning, all in Kansas City, Jackson County, Missouri.

AND

The South half of vacated Cloon Avenue lying North of and adjacent to Lots 3-8, MAPLE GROVE, and the vacated alley lying North and South of Lots 4-14, MAPLE GROVE, all in Kansas City, Jackson County, Missouri.

Section 2. That the Council has duly made the findings necessary for compliance with Section 100.300-100.620, RSMo, including a finding that the area to be added to the plan area is blighted, insanitary or an undeveloped industrial area and its redevelopment necessary for the preservation of the public peace, prosperity, health, safety, morals and welfare, that ad valorem tax benefits pursuant to Section 100.570, RSMo are necessary to attract developers to the area and are hereby approved, subject to the approval of an industrial development contract by the Authority and compliance with applicable law.

Section 3. That First Amendment to the General Development Plan is hereby found to be feasible and in conformance with the general plan for the development of the community as a whole.
