COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 010676

 

Approving a Community Unit Project on an approximately 13.19 acre tract of land generally located approximately 500 feet west of Wornall Road and on the south side of 99th Street, extending south approximately 900 feet to 100th Terrace. (12529-CUP-1)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 13.19 acre tract of land generally located approximately 500 feet west of Wornall Road and on the south side of 99th Street, extending south approximately 900 feet to 100th Terrace, and more specifically described as follows:

 

This is a replat and resurvey of all of Lot 3, Lot 6 and Woods Road right of way from the north line of said Lot 3 to the south line of said Lot 6, Pioneer Hill, a subdivision of land in the Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the northwest corner of said Lot 3; thence South 89E12'00" East, along the north line of said Lot 3 and the north line of Section 31, Township 48, Range 33, a distance of 750.04 feet, to the point on the easterly right of way line of said Woods Road; thence South 00E00'00" West, along the easterly right of way line of said Woods Road, a distance of 120.00 feet, to a point of curvature; thence southerly and southeasterly, continuing along said easterly right of way line, along a curve to the left, having a radius of 573.70, a central angle of 20E59'59", a distance of 210.27 feet, to a point of reverse curvature; thence southeasterly and southerly, continuing along said easterly right of way line, along a curve to the right, having a radius of 1432.70 feet, a central angle of 16E00'00", a distance of 400.09 feet; thence South 04E59'01" East, continuing along said easterly right of way line, a distance of 191.78 feet, to a point on the northerly right of way line of Pioneer Road; thence North 89E12'00" West, along said northerly right of way line, a distance of 574.81 feet, to the southwest corner of said Lot 6; thence North 00E01'05" East, along the west line of said Lot 6, a distance of 523.19 feet, to the northwest corner of said Lot 6; thence North 89E12'00" West, along the south line of said Lot 3, a distance of 320.00 feet, to the southwest corner of said Lot 3; thence North 00E01'05" East, along the west line of said Lot 3, a distance of 380.00 feet to the point of beginning. Containing 13.1881 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer construct any improvements as required by the City Engineers Office.


3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer dedicate additional right of way for 99th Street as required by the Department of Public Works so as to provide a total of 30 feet of right of way as measured from the centerline of 99th Street.

 

7. That the developer improve the south half of 99th street to collector street standards as required by the Department of Public Works, including construction of curb, gutter and sidewalks and installation of streetlights.

 

8. That the developer improve the north half of 100th Terrace to residential street standards as required by the Department of Public Works, including construction of curb, gutter and sidewalks and installation of streetlights.

 

9. That the developer dedicate the right of way for a permanent turnaround for the termination of 100th Terrace as shown on the Community Unit Project plan as required by the Department of Public Works.

 

10. That the developer construct a permanent turnaround at the termination of 100th Terrace as required by the Department of Public Works.

 

11. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

12. That the developer extend water mains as required by the Water Services Department.

 

13. That the developer submit a street name signage plan to the Street Naming Committee for approval prior to the submittal of the first final plat.

 

14. That the developer extend sanitary sewers as required by the Department of Public Works.

 

15. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

16. That the developer secure the approval of the Board of Zoning Adjustment for any proposed neighborhood identification signs prior to the issuance of a sign permit.

 

17. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, grading signage and building elevations.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 010676, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
