ORDINANCE NO. 100295

 

Authorizing the Director of Water Services to expend $2,500,000.00 for the City’s current contribution under the Turkey Creek Project Cooperation Agreement (PCA) between the U.S. Federal Government, through the U.S. Army Corps of Engineers, the Unified Government of Wyandotte County/Kansas City, Kansas (UG), and the City of Kansas City, Missouri; and recognizing an emergency.

 

WHEREAS, by Ordinance No. 63673, the City authorized a feasibility study with the U.S. Army Corps of Engineers and the UG to formulate a flood damage reduction project for Turkey Creek; and

 

WHEREAS, by Resolution Nos. 950301 and 990018, the City expressed its vigorous and continued support of the Turkey Creek Flood Control Project and requested the U.S. Army Corps of Engineers to accelerate the project; and

 

WHEREAS, by Ordinance Nos. 990396 and 991508, the City authorized a cost-sharing agreement with the U.S. Army Corps of Engineers to design the Turkey Creek Flood Damage Reduction Project; and

 

WHEREAS, by Ordinance No. 041333, the City authorized the expenditure of $3,900,000.00 for its share of the Turkey Creek tunnel rehabilitation being undertaken as part of the Turkey Creek flood damage reduction project in cooperation with the U.S. Army Corps of Engineers and the UG; and

 

WHEREAS, by Ordinance No. 060666, the City authorized the PCA, the agreement between the City and the UG, and expenditures for the Turkey Creek flood damage reduction project; and

 

WHEREAS, by Ordinance No. 081225, the City authorized the expenditure of $3,000,000.00 for its then current contribution under the Turkey Creek PCA between the U.S. Army Corps of Engineers, the UG, and the City; NOW, THERFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Director of Water Services is hereby authorized to expend the sum of $2,500,000.00 from funds previously appropriated to Account No. 10-3090-808054-B, Turkey Crk Fld Ctrl Mitigation, Project No. 89003209, for the City’s current cost share of the PCA.

 

Section 2. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an emergency measure within the provisions of Section 503 of the City Charter and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the designated appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
