Amending a previously approved
Chapter 80 preliminary development plan in District GP-3 on about 12.92 acres
located on the west side of N.W. Prairie View Road, approximately 1,000 feet
north of N.W. Tiffany Springs Road, by removing the north 5.5 acres from the
plan, and thereby leaving the south 7.42 acre portion. (10251-P-27)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That an
amendment to a previously approved Chapter 80 preliminary development plan in
District GP-3 (Regional Business), on about 12.92 acres located at 9300 and
9400 N.W. Prairie View Road, or on the west side of N.W. Prairie View Road,
approximately 1,000 feet north of N.W. Tiffany Springs Road, which removes the north
5.5 acres from the plan, and more specifically described
as follows:

All of Lots 1
and 2 and Tracts A and B, Tiffany springs Auto Plaza II, a subdivision of land
in the Northeast Quarter of Section 1, Township 51 North, Range 34 West of the
5th Principal Meridian in Kansas City, Platte County, Missouri. Containing
12.92 acres, more or less.
Area to Be
Removed:
All of Lot 2 and
Tract B, Tiffany Springs Auto Plaza II, a subdivision of land in the Northeast
Quarter of Section 1, Township 51 North, Range 34 West of the 5th Principal
Meridian in Kansas City, Platte County, Missouri. Containing 5.50 acres, more
or less.
Remaining
Plan Area:
All of Lot 1 and
Tract A, Tiffany Springs Auto Plaza II, a subdivision of land in the Northeast
Quarter of Section 1, Township 51 North, Range 34 West of the 5th Principal
Meridian in Kansas City, Platte County, Missouri. Containing 7.42 acres, more
or less.
is hereby approved, subject to the following conditions:
1. That
the developer submit an update to the previously accepted micro storm drainage
study for the development to address the development amendments along with a
BMP level of service analysis for review and acceptance prior to issuance of
any building permits and make necessary improvements as required by Development
Services prior to the issuance of any certificate of occupancy.
2.
That the developer secure a site disturbance permit from Development
Services prior to beginning any construction, grading, clearing, or grubbing
activities, if the disturbed area equals one acre or more.
3. That
the developer grant a BMP Easement to the City, if any, as required by
Development Services, prior to the issuance of any certificate of occupancy.
4.
That the developer submit a final plan to the City Plan Commission for
approval, including plans for grading, landscaping, screening, berming, photometric
study and building elevation drawings.
A copy of said development plan is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by the Zoning
Ordinance have been given and had.
