ORDINANCE NO. 050646

 

Approving the preliminary plat of The Woods of Maple Hills on a 10.47 acre tract of land generally located north of N.E. 50th Street between N. Bellaire Avenue and N. Belmont Avenue. (SD 1132).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of The Woods of Maple Hills on a 10.47 acre tract of land generally located north of N.E. 50th Street between N. Bellaire Avenue and N. Belmont Avenue, and more specifically described as follows:

 

The East 128 ft. of Lots 42 through Lots 48, Lots 14 through 35, Block 5; Lots 8 through 41, Block 6: Lots 25 through Lot 41, Block 7: Lots 1 through 11, and Lots 38 through 49, Block 12; Maple Hills Addition, a subdivision in Kansas City, Clay County, Missouri, plus Vacated Streets adjacent to said lots.

 

is hereby approved, subject to the following conditions:

 

1. That the developer verify sanitary sewer capacity for a minimum of the next 4 downstream segments north of project, prior to ordinance request.

 

2. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

3. That the developer submit a macro/micro storm drainage study to the City Engineer's Office for approval for the entire development when the final plat is submitted, and that the developer construct any improvements as required by the City Engineer's Office.

 

4. That the developer submit plans for grading, siltation, and erosion control to the City Engineer's Office for approval and permitting prior to beginning any construction activities.

 

5. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

6. That the developer request the Department of Public Works to initiate an ordinance to establish or reestablish the grade on existing streets that are being improved where existing grades change by more than 6 inches and the grades have been previously established.

 

7. That the developer secure a site disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

8. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five (5) acres.

 

9. That the developer contribute $11,356.96 in lieu of parkland dedication for 40 units (40 units 3.7 .006 $12,789.30 (year 2004) = $11,356.90) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

10. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

11. That the developer extend water mains as required by the Water Services Department.

 

12. That the developer extend sanitary sewers and/or storm sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by the Department of Public Works.

 

13. That the developer submit a Street Name Signage Plan for the entire development area for approval by the Street Naming Committee prior to submittal of the final plat.

 

14. That the developer petition for the vacation of N.E. 51st Street as shown on the preliminary plat.

 

15. That the developer submit a street tree planting plan as part of the final plat, secure the approval of the City Forester for street trees planted on right-of-way in front of residential lots (with a copy to be submitted to the City Development Department staff), and agree to plant in conformance with the plan approved by the City Forester. The plan shall include size, type, species, and placement of trees.

 

16. That the developer dedicate additional right of way for a local street as required by the Department of Public Works so as to provide a minimum of 25 feet of right of way as measured from the centerline of N.E. 50th Street.

18. That the developer improve N. Belmont Avenue to local street standards from the north project limit line to the center of the intersection at N.E. 50th Street, as required by the Department of Public Works, including curbs, gutters, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

19. That the developer improve the north half of N.E. 50th Street to local street standards from the west right-of-way line of N. White Avenue to the east right-of-way line of N. Wheeling Ave., as required by the Department of Public Works, including curbs, gutters, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

20. That the developer construct N. Wheeling Avenue to local street standards from the north right of way limits at the intersection of N.E. 51st Street to the center of the intersection at N.E. 50th Street, as required by the Department of Public Works, including curbs, gutters, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

21. That the developer construct N. White Avenue to local street standards from the north limits depicted on the preliminary plat to the center of the intersection at N.E. 50th Street, as required by the Department of Public Works, including curbs, gutters, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

22. That the developer design and construct all interior streets to City standards as required by the Department of Public Works, including curb, gutter, storm sewers, streetlights, and sidewalks.

 

23. That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by the Department of Public Works and that the developer shall be responsible for all costs associated with subordination activities.

 

24. That any relocated streetlights be integrated into the existing street light system as required by the City Engineers Office.

 

25. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
