ORDINANCE NO. 080984

 

Approving an amendment to a previously approved preliminary plan in District PD/M-2a on an 8 acre tract of land generally located at the southeast corner of E. 29th Street and Wheeling Avenue. (8234-PD-6)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District PD/M-2a (Planned Development, Heavy Industry) on an 8 acre tract of land generally located at the southeast corner of E. 29th Street and Wheeling Avenue, and more specifically described as follows:

 

The North 1/2 of the east 480 feet of Lot 3, Commissioners Plat 2 of the Estate of Levi Owing, Deceased, in the Northwest 1/4 of Section 13, Township 49, Range 33, in Kansas City, Jackson County, Missouri, or record in Book B-591, page 507, Document No. 246612, said east 480 feet of said Lot 3 being described as beginning 132 feet north of the northeast corner of the Southwest 1/4 of the Northwest 1/4 of Section 13, Township 49, Range 33, and running thence south 726 feet; thence west 480 feet; thence north 726 feet and thence east 480 feet to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer submit plans for grading and siltation and erosion control to Development Services for approval prior to beginning any construction activities.

 

2. That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area equals or exceeds one acre.

 

3. That the developer construct hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

4. That the developer extend water mains as required by the Water Services Department.

 

5. That the developer prohibit truck access at the westerly driveway as shown on the development plan to or from 29th Street as required by Development Services.

 


6. That the developer submit a detailed micro storm drainage study prior to approval and issuance of any building permits, and that the developer construct any improvements as required by Development Services prior to issuance of a certificate of occupancy.

7. That the developer submit a final plan to the City Plan Commission for approval, including detailed information on grading, landscaping, signage (including elevations), building elevations, and a photometric study showing zero footcandles at the property line and no direct illumination beyond the plan boundary.

 

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
