Determining
compliance of a portion of Phase II of the Jazz District Redevelopment Project
located at 1851 Paseo, 1602-26 E. 19th Street and 1830-38 Highland Avenue and
authorizing the Director of City Development to issue a Certificate of Full
Compliance for the portion of Phase II to the Jazz District Redevelopment
Corporation.
WHEREAS, the
Jazz District Redevelopment Corporation filed with the City Clerk of the City,
the Jazz District Redevelopment Plan, as revised (the Development Plan)
providing for the construction of the Jazz District Redevelopment Project in
the City (the Redevelopment Project) in the Jazz District Redevelopment Area
described in the Development Plan and in Section 2 of the Redevelopment
Contract (Redevelopment Area), together with an application for approval of
the Development Plan;
WHEREAS, the
City Council of the City (City Council) passed Committee Substitute for
Ordinance No. 980609 (the Ordinance) on June 4, 1998, which ordinance
approved the application and Development Plan of the Jazz District
Redevelopment Corporation and authorized and directed the Director of Finance
to enter into a contract with the Jazz District Redevelopment Corporation; and
WHEREAS, the
Jazz District and the City executed the Redevelopment Contract on May 27, 1999;
and
WHEREAS, the
Jazz District, on February 1, 1999, filed a First Amendment to the Development
Plan with the City Clerk to provide for certain changes, including the
possibility of constructing a parking deck at the Attucks school site.
WHEREAS, the
City Council passed Ordinance No. 990399 on March 25, 1999, which ordinance
approved the First Amendment to the Development Plan and authorized and
directed the Director of Finance to enter into a First Supplemental Contract
with Jazz District; and
WHEREAS, a
portion of Phase II of the Redevelopment Project located in three separate
buildings at three locations generally on the north
side of 19th Street between The Paseo on the west and Highland Avenue on the
east and also known as 1851 Paseo, 1602-26 E. 19th Street and 1830-38 Highland
Avenue have constructed a total of 78 apartment units and 78 parking
spaces in accordance with the 353 contract and URD plan for the Jazz District
Redevelopment area; and
WHEREAS, the
Jazz District Redevelopment Corporation has requested a Certificate of Full
Compliance for a portion of Phase II; and
WHEREAS, Donald
Rosemann, an Architect for the Redevelopment Project, has identified that the Project
as built consists of construction of 78 apartment units in three residential
buildings and 78 parking spaces, have been constructed; and
WHEREAS, on
November 20, 2007, the City Plan Commission reviewed the Development Plan and
determined that the construction proposed in the Development Plan for Phase II
of Jazz District Redevelopment Project at 1851 Paseo,
1602-26 E. 19th Street and 1830-38 Highland Avenue has occurred and has
recommended that the City Council authorize the issuance of a Certificate of
Full Compliance to Jazz District Redevelopment Corporation; NOW, THEREFORE,
BE IT
RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section A.
That the Council finds and determines that Phase II of the Jazz District
Redevelopment Project located at 1851 Paseo, 1602-26
E. 19th Street and 1830-38 Highland Avenue has been completed and the
construction is in compliance with the approved 353 Development Plan.
Section B.
That the Council hereby authorizes the Director of City Development to issue a
Certificate of Full Compliance to Jazz District Redevelopment Corporation
pursuant to the terms and conditions of the Development Plan and Redevelopment
Contract and pursuant to Section 74-17, Code of Ordinances of the City of
Kansas City, Missouri, for Phase II.
