COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 900635.1
Authorizing the Director of Fire on behalf of Kansas
City, Missouri, to enter into a contract in the amount of $100,000.00 with
Environmental Specialists, Inc. to use their special facilities in abating the
public nuisance created by the brush landfill fire in southeast Kansas City,
Missouri; and recognizing an emergency.

WHEREAS, a dangerous situation exists within Kansas
City near 78th & Monroe where an accumulation of refuse consisting largely
of tree limbs, leaves, weeds, grass and other waste from vegetation has caught
fire and is burning below the surface; and
WHEREAS, normal fire suppression procedures are
ineffective and because the burning is under an overhang, is below the surface
and is encapsulated by a crust resulting from drainage into the area where the
refuse is located, the work of removing the refuse safely is of a specialized
character for which the Environmental Specialists company is uniquely qualified
by virtue of its specialized equipment and past experience; and
WHEREAS, the situation constitutes an emergency
endangering lives and property within Kansas City in that the smoke from the
fire is affecting the residents in the vicinity of the fire and runoff from the
fire area is damaging the ecology in a large area; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY;
Section 1. That the Director of Fire, on behalf of
Kansas City, is authorized to enter into a contract, in the amount of One
Hundred Thousand and no/100 Dollars ($100,000.00) with the Environmental
Specialists, Inc. who will use special equipment and expertise to dismantle the
burning brush landfill affording the Fire Department a chance to extinguish the
fire at 78th & Monroe, Kansas City, Missouri. The work shall be done in
accordance with the terms of the agreement which is hereby approved and
confirmed and a copy of this contract is on file in the office of the Director
of Fire.
Section 2. That the revenue in the following
account of the General Fund is hereby estimated in the following amount:

Section 3. That the sum of $83,906 is hereby
appropriated from the Unappropriated Fund Balance of the General Fund, Account
No. 1-801, to the following account in the General Fund:
1-30410B Fire Department-Landfill Fire $

Section 4. That the sum of $16,094 is hereby
transferred from the Contingent Appropriation of the General Fund, Account No.
1-96100B, to the following account in the General Fund:
1-30410B Fire Department-Landfill Fire

Section 5. That the sum of $100,000.00 is hereby
appropriated to account number 1-30410B, Landfill Fire, and the Director of
Fire is hereby designated as the requisitioning authority for said account.
Section 6. That the Director of Fire is hereby
authorized to expend up to the sum of $100,000.00 from funds herein
appropriated to account number 1-30410B, Landfill Fire, to satisfy the cost of
this contract, including changes deemed necessary.
Section 7. That because this burning brush
landfill constitutes an emergency endangering the public health, safety and
welfare this ordinance is recognized to be an emergency measure within the
provisions of Article II, Section 15 of the Charter and shall take effect
immediately upon passage.
