ORDINANCE NO. 960148

 

Amending Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 65.010A2636, rezoning an area of approximately 4.5 acres generally located at 6100 East 63rd Street from District M-1 (Light Industry) to District PD/M-1 (Planned District/Light Industry), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 65, Revised Ordinances of Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 65.010A2636, rezoning an area of approximately 4.5 acres generally located at 6100 East 63rd Street from District M-1 (Light Industry) to District PD/M-1 (Planned District/Light Industry), said section to read as follows:

 

Section 65.010A2636. That an area legally described as:

 

All that part of the West Half of the Northwest Quarter of Section 1, Township 48, Range 33 in Kansas City, Jackson County, Missouri, being more particularly described as follows: Commencing at the northwest corner of the Northwest Quarter of said Section 1; thence along the north line of said Northwest Quarter, South 87 22'39" East, 836.59 feet to a point on the easterly right of way line of the Kansas City Southern Railway Company (75 feet from the centerline thereof); thence along the easterly right of way line of said Railroad (75 feet from the centerline thereof), South 09 42'01" East, 203.00 feet to a point of curve; thence continuing along said easterly right of way line, in a southerly direction, along a curve to the right (having a radius of 1985.08 feet), 205.20 feet to the point of beginning; thence leaving said easterly right of way line, South 87 21'43" East, 271.12 feet to a point 133 feet west of the east line of the West Half of the Northwest Quarter of said Section 1; thence parallel to the east line of the West Half of said Northwest Quarter, South 02 13'06" West, 32.00 feet to a point 433 feet south of the north line of said Northwest Quarter; thence parallel to the north line of said Northwest Quarter, South 87 22'39" East, 133.00 feet to a point on the east line of the West Half of said Northwest Quarter; thence along the east line of the West Half of said Northwest Quarter, South 02 13'06" West, 529.33 feet to a point on the northerly right of way line of 63rd Street (40 feet from the centerline thereof); thence along the northerly right of way line of 63rd Street the following courses and distances: North 62 38'57" West, 134.73 feet to a point of curve; thence in a northwesterly direction, along a curve to the left (having a radius of 751.63 feet), 137.33 feet; thence North 16 52'56" East, 5.00 feet; thence along a curve to the left (having a radius of 756.63 feet and an initial tangent bearing of North 73 07'04" West), 106.32 feet; thence South 08 49'52" West, 5.00 feet; thence along a curve to the left (having a radius of 751.63 feet and an initial tangent bearing of North 81 10'08" West), 14.18 feet to a point on the easterly right of way line of the Kansas City Southern Railway Company (100 feet from the centerline thereof); thence along the easterly right of way line of said Railroad the following courses and distances: North 02 20'29" East, 95.53 feet; thence North 87 39'31" West, 25.00 feet; thence North 02 20'29" East, 132.17 feet to a point of curve; thence in a northerly direction along a curve to the left (having a radius of 1985.08 feet), 212.00 feet to the point of beginning, containing 4.225 acres more or less.

 

is hereby rezoned from District M-1 (Light Industry) to District PD/M-1 (Planned District/Light Industry), all as shown outlined on a map marked Section 65.010A2636, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 65.010 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following condition:

 

That the developer construct sidewalks along the north side of 63rd Street at such time as sidewalks are constructed to the east.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 960148, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
