ORDINANCE NO. 970288
Amending Chapter 80, Code of Ordinances of the City of
Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding
a new section to be known as Section 80-11A0034, rezoning an area of
approximately 10.5 acres generally located on the south side of 103rd Street at
Madison Avenue from Districts C-2 (Local Retail Business) and C-2-p (Local
Retail Business - Limited District) to District C-2-p (Local Retail Business -
Limited District), and approving a preliminary plan for the same. (10179-P-6)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 80, Code of Ordinances of
the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance,
is hereby amended by enacting a new section to be known as Section 80-11A0034,
rezoning an area of approximately 10.5 acres generally located on the south
side of 103rd Street at Madison Avenue from Districts C-2 (Local Retail
Business) and C-2-p (Local Retail Business - Limited District) to District
C-2-p (Local Retail Business - Limited District), said section to read as
follows:
Section 80-11A0034. That an area legally described
as:
Lot 1, Superior Datsun-Buick First Plat; Lot 1,
Superior Datsun-Buick Second Plat; Lots 1 and 2, Superior Datsun-Buick
Third Plat; Lot 1, Superior Datsun-Buick Fourth Plat; Lot 1, Superior
Hyundai, all subdivisions in Kansas City, Jackson County, Missouri,
according to the recorded plats thereof and all of that part of the
Northwest 1/4 of the Southeast 1/4 of Section 31, Township 48, Range 33,
beginning at a point 333 feet south of the northeast corner of said 1/4
1/4, thence east 20.16 feet, thence southeasterly on a curve to the right,
15 feet, thence 23.4 feet, thence south 115.16 feet, thence west 35 feet,
thence north to the point of beginning, all in Kansas City, Jackson
County, Missouri.
is hereby rezoned from Districts C-2 (Local Retail
Business) and C-2-p (Local Retail Business - Limited District) to District
C-2-p (Local Retail Business - Limited District), all as shown outlined on a
map marked Section 80-11A0034, which is attached hereto and made a part hereof,
and which is hereby adopted as a part of an amendment to the zoning maps
constituting a part of said chapter and as an amendment to Section 80-11
thereof.
Section B. That a preliminary plan for the area
legally described above is hereby approved, subject to the following
conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer dedicate additional right of
way for 103rd Street as required by the Department of Public Works so
as to provide 40 feet of right of way as measured
from the centerline of 103rd Street; provided
that the developer may enter into a
deferral agreement for the dedication of the
right of way at such time as all necessary
right of way for 103rd Street has been obtained
and the City is prepared to make the
street improvements.
3. That the developer contribute a total of
$8,715.00 for the I-435/103rd Street Corridor Improvement Fund based
on a rate of $1.00 per square foot for the additional floor
area as required by the Department of Public
Works; such contributions to be paid at
the time of building permit.
4. That the developer extend water mains as
required by the Water Services Department.
5. That the developer provide fire protection as
required by the Fire Department.
6. That the developer submit a final plan for each
stage to the City Plan Commission for approval. The final plans
shall include: site plan; dimension plan; grading plan;
landscape plan; and signage plans.
A copy of said preliminary plan is on file in the office
of the City Clerk under Document No. 970288, which is attached hereto and made
a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
