Approving the preliminary plat of
Westport Colonnade Condominium on a .38 acre tract of land generally located at
3803 Pennsylvania Avenue. (SD 1203)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat Westport Colonnade Condominium on a .38 acre tract of land
generally located at 3803 Pennsylvania Avenue, and more specifically described
as follows:
The north 18 feet of Lot 15 and all of Lot 16, A.B.H.
McGees Addition, a subdivision in the City of Kansas City, Jackson County
Missouri, described as follows: Beginning at the northwest corner of said Lot
16; thence North 89 degrees 52 minutes 48 seconds East along the north line
thereof 195.07 feet to the northeast corner thereof; thence South 00 degrees 04
minutes 37 seconds West 84.09 feet; thence South 89 degrees 52 minutes 48
seconds West 195.07 feet; thence North 00 degrees 04 minutes 37 seconds East
84.09 feet to the point of beginning.
is hereby approved, subject to
the following conditions:
1. That the developer cause the area to be platted and processed
in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri,
commonly known as the Subdivision Regulations.
2. That the developer submit covenants, conditions and
restrictions to the Law Department for approval for the maintenance of common
areas and private open space tracts.
3. That the developer secure permits to repair alleys,
sidewalks, curbs, and gutters as necessary along all development frontages as
required by the Department of Public Works in accordance with Chapters 56 and
64, Code of Ordinances, prior to recording of the plat.
4. That the developer dedicate additional right of way as
required by Development Services so as to provide a minimum of 25 feet of right
of way as measured from the centerline of Pennsylvania Avenue.
5. That the developer receive approval of setback variances.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
