COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 051423

Approving an amendment to a previously approved preliminary plan in District CP-2 on approximately a 24.49 acre tract of land generally located at the northeast corner of the intersection of N.E. Cookingham Drive and N. Ash Avenue which removes 1.92 acres from the plan and leaves 22.57 acres. (6158-CP-19)

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That an amendment to a previously approved preliminary plan in District CP-2 (Local Planned Business Center) on approximately a 24.49 acre tract of land generally located at the northeast corner of the intersection of N.E. Cookingham Drive and N. Ash Avenue which removes 1.92 acres from the plan and leaves 22.57 acres, more specifically described as follows:

A tract of land in the Southwest Quarter of Section 36, Township 52, Range 32, Kansas City, Clay County, Missouri, being bounded and described as follows: Commencing at the Northwest corner of said Southwest Quarter; thence South 8925'26" East, along the North line of said Southwest Quarter, 1381.99 feet; thence South 034'34" West, 1495.78 feet to the True Point of Beginning of the tract to be herein described, said point being also a point on the South line of AMBER MEADOWS - FIRST PLAT, a subdivision of land in Kansas City, Clay County, Missouri, said point being also a point on the East right-of-way line of N. Ash Avenue, as now established; thence South 3746'53" East, along said South line, 178.82 feet; thence North 6415'23" East, along said South line, 218.42 feet; thence North 8126'01" East, along said South line, 122.14 feet; thence South 8919'47" East, along said South line, 500.53 feet to a point on the Kansas City City Limit line; thence South 033'25" West, along said City Limit line, 880.62 feet to a point on the Northerly right-of-way line of Missouri Highway A, as now established; thence Southwesterly, along said Northerly line, on a curve to the left, having an initial tangent bearing of South 6808'34" West, a radius of 636.62 feet, an arc distance of 159.63 feet; thence South 5346'34" West, along said Northerly line, 224.84 feet to a point on the Northeasterly right-of-way line of Missouri Route 291, as now established; thence North 6520'43" West, along said Northeasterly line, 540.07 feet; thence North 6656'13" West, along said Northeasterly line, 473.66 feet; thence South 2605'19" West, along said Northeasterly line, 15.00 feet; thence North 6351'21" West, along said Northeasterly line, 59.36 feet; thence Northwesterly, Northerly and Northeasterly, along the East right-of-way line of said N. Ash Avenue, on a curve to the right, tangent to the last described course, having a radius of 15.00 feet, an arc distance of 23.56 feet; thence North 2608'39" East, along said East line, 140.04 feet; thence Northeasterly, along said East line, on a curve to the left, tangent to the last described course, having a radius of 800.00 feet, an arc distance of 126.62 feet; thence Northeasterly, along said East line, on a curve to the right, having a common tangent to the last described course, a radius of 800.00 feet, an arc distance of 126.62 feet; thence North 2608'39" East, along said East line, 52.01 feet; thence Northeasterly, along said East line, on a curve to the right, tangent to the last described course, having a radius of 770.00 feet, an arc distance of 163.83 feet; thence North 3820'05" East, along said East line, 32.01 feet; thence Northeasterly, along said East line, on a curve to the right, tangent to the last described course, having a radius of 675.00 feet, an arc distance of 156.12 feet to the True Point of Beginning. is hereby approved.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit new or update the previously approved macro storm drainage study for the overall development to address the development amendments along with a detailed micro study for approval prior to approval of the next plat and make necessary improvements as required by Development Services.

 

3. That the developer improve N. Ash Avenue to collector street standards as required by the Department of Public Works, including curbs, gutters, sidewalks, streetlights, existing roadway section transitions to meet vertical and horizontal alignment standards, and relocation of utilities.

 

4. That the developer obtain the grading consents, and all grading, temporary construction and drainage/sewer easements from the abutting property owner prior to submitting any public improvements.

 

5. That the developer secure permits to construct or reconstruct existing sidewalks, curb, gutter, storm sewers, and streetlights as necessary along all development street frontages, as required by the Department of Public Works, prior to recording the next plat.

 

6. That any relocated streetlights be integrated into the existing street light system as required by Development Services and the Missouri Department of Transportation along State frontages.

 

7. That the developer secure a permit from the Missouri Department of Transportation prior to working within any State highway right-of-way.

 

8. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

9. That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area exceeds one acre.

 

10. That the developer extend sanitary sewers and provide a storm water conveyance system to ensure individual service is provided to all proposed lots and determine adequacy as required by the Department of Public Works.

 

11. That the developer provide fire protection as required by the Fire Department.

 

12. That the developer submit covenants, conditions and restrictions to the Law Department for approval for the maintenance of private open space and enter into a covenant agreement for the maintenance of any stormwater detention area tracts.

 

13. That the developer submit a final plan to the City Plan Commission for approval, showing grading, landscaping, berming and screening, showing a 4 foot minimum high continuous berm with conifers extending across the entire back of the service area except a break where the walking trail goes through, building elevations and a photometric study showing zero footcandles at the property line.

 

14. That the developer complete the walking trail to the north of the site as part of the commercial development connecting south to the sidewalk in front of the commercial buildings.

A copy of said amendment is on file in the office of the City Clerk with this ordinance and is made a part hereof.

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
